Need direction on next step.

This is my sister's case:

My BIL was in the u.s illegally, and they went through the motions (sis is a u.s citizen) they filled out for an i-130 and all other paperwork, they finally went to juarez to finalize last week.

we'll it appears on one of the times that he tried crossing illegally, he was officially deported (unknowingly), and they denied the application and deported him for 10 years. my sister is beside herself they have 5 kids. she doesn't know what to do.

she went to see a lawyer that will charge her $3500 to fill out an I-290b. and there is no guarantee.

my question is: is it worth it? what are his chances of winning an appeal. they told him that the 1st deportation would have been up this coming year 2009. my sister works, but with 5 kids, it will he extremely hard.

Pretty tough. It's true, will cost a lot...especially in those cases and there is never a guarantee...is not really in the hands of the lawyer, what h/she needs to do is to write a pretty well convince appeal. To say only that he has 5 kids with his US citizen wife...is not enough.

It's a long shot but I don't see major way outs in here. Plus you need to find a lawyer that can know pretty well all about his deportation issues...Has he been arrested before? crossing illegaly...something like that?

Nothing with immigration is a guarantee, you are looking for a benefit, regardless if you have kids, a US citizen spouse, etc.

If the appeal fails, he will be deported and banned from the US for life (inadmissible alien). Get the best lawyer you can find. Even $10,000 is cheap in comparison to the alternative.
