Hi,
In april of 2001, my aunt (U.S. citizen) petitioned my mother for a green card (we live in the U.S.) The priority date arrived in August of 2010 and our "attorney" filed i485 for my mother. My brother and I were 15 and 12 when the petition was filed and as I understand, under CSPA we are still eligible now that we're 25 and 22. This stupid attorney failed to file i485 for me and my brother at the same time. My mother already got her green card! I have been advised by immigration officers that if I apply now, they will deny the application because there are no more visas for now. I would be happy to wait until more become available (should be another year or so) but it is also my understanding that I only have 1 year after the priority date became current to file for a green card under CSPA. Is this true? what can I do?
