Hi all,
If you are doing AOS, I read somewhere that you are not supposed to send the ds 230 forms back to KCC, then does that mean you are exempted from answering/giving info required in form ds 230? At one time will you be required to fill the form 230 when doing AOS? For those who want the family (spouse/kids) to follow later when/how are they supposed to communicate this? Before, during or after the interview?
As a couple can one do AOS and the other CP in a situation where one is ineligible to do AOS?
Your response will be highly appreciated.[/B][/B]

NOrmally if you do AOS, once u get ur successful in your AOS interview, USCIS will have to notify the embassy back home and your family members can then do follow-in interview in embassy. I am not exactly sure what the procedure is or how to fill up DS 230 for this though..

I vaguely remember this. I believe you should submit both forms to KCC. One the form indicates if you have eligible members of family that are reside outside US while you are doing AOS.

The best way is calling KCC. Ask what need to be filled on the processing (AOS or CP) and also what the next step is. Is doing CP out of question here? Knowing immigration matter can be confusing and frustating sometimes, try to make it as simple as possible.

If you can do CP that would be better because you (and the whole family) can apply together, rather than you doing AOS and the others doing CP.

What country are you from?

The embassy in Nigeria does not need you to file the I-824 after your case is approved, they will acknowledge a cable from the USCIS confirming your change of status.

Knowing how long that will take or how long your AOS case will be vital to whether your family will have enough time to get a visa before september 30, 2009.
