Need AP before Dec 15th HELP!

My husband is a French citizen and his GC has been approved pending FBI name check.

We sent off the AP last week. I know our chances of getting the AP in our hands by the 15th is pretty slim.

He had an HB1 Visa from his place of employment (no longer employed there since last Spring) I assume the employer canceled it. Could he use that to enter the country?

Can we apply for an emergency parole at our local DO? We already have our plane tickets.

Valid stamp in the passport without valid H status, like your case, will not work.
If you have an emergency situation just take an Infopass to your local office to see what will hapen. travelling without AP or valid H status (visa and status) will adverselly affect your pending I-485. I am not so familiar with the visa waiver program being a French citizen in your case.
