Hi, i'm going to do my citizenship test tomorrow and i have a question. I was cited for public intoxication in the summer of 2005 but I got it deferred adjudicated and this year i plan on getting an expunction. can you let me know if i will likely be denied for this reason?

my record has been clean since then, except for 3 parking tickets that i am aware of (no traffic/speeding violations). does a parking ticket count as a traffic violation?

Have you mentioned on the N400 application about the intoxication citation? Make sure you take all the court documents with you. You should not be in trouble because of that.

Parking tickets are not counted as traffic violations.

My mom was the one who did my application, and I don't think she wrote that on there. I mistakenly did not tell her of it, because it was deferred adjudicated. I did some more research and realized my mistake. My records are in another city, but I know which court processed it and who the judge was. My other problem was that I was 17 at the time, so I don't know if that makes a difference?

When you go to the interview, you will be asked if you need to make any changes to the application so make sure you let the IO know about this omission. The IO would want to see the court documents, so if possible, try to get them before your interview tomorrow. Do make sure you let the IO know about the omission or else you may be rejected for bad moral character for lying.

Make sure you mention it during the interview. I think a single instance of public intoxication should not lead to denial. However, if you don't mention this during the interview it might lead to a denial. It is almost certain that your application won't be recommended for approval at the end of the interview, but in all likelihood it will be approved when reviewed by a supervisor. It is very important that you don't attempt to hide this arrest or citation during the interview.

Thanks so much for the reply! Yeah, I was for sure going to tell them, I just wanted to know what my chances were for denial. Even though it was indicted as a Class C misdemeanor (equivalence of a traffic violation), it just looks bad.

My interview will be held at 6:30am before the offices of the Judge will be open, so I am for SURE not going to be able to bring ANY type of documents along. Will that penalize me?

And how long does it normally take for supervisory review?

Yes, your case will be delayed until you supply the papers. Make sure to mention the incident whether the interviewer asks for it or not, because it almost surely is in the system (even if expunged, USCIS still gets a record of it from the FBI), and if you don't mention it but the supervisor in the system sees it, your case will be denied.

Anywhere from a few hours to months. Usually a few weeks though.

Did your mother put down her name and signature on the N400 as the form preparer?
