A co-worker of mine has been on his H-1 visa for almost six years (expires in March). For some reason he did not start his LC application until August of last year. Now he is in trouble because according to the typical processing time for LC, his LC won't be approved before his H-1 expires in March. This means he will have leave the company and the country in March. Is there anything he can do to fix this?
I heard something about a 7th year H-1 extension but I heard that it only applies if your LC has been pending for more than a year.

Any advise is very much appreciated!

As "immigration4kot" suggested, try to find employer who is willing to do substitute LC with your matching skills.

If/when you find one, apply I-485/140 right away and that will keep your stay legal.
 
I'm still not sure what you mean. Shouldn't your LC be approved before you apply for I-140/485? His H-1 expires in March and his LC won't be approved before then. Besides, he has been with the company for six years and we would rather keep him here than have him look for another employer.

We were talking about "Substitute labor". Anyway, following are other options available.


a) AC 21, as amended by DOJ Authorization Act: If a labor certification application is pending or I-140 is pending and 365 (oops!) day has passed, he/she can apply for H-1B extension indefinitely in one-year increment until the decision is made one way or another. If approved, it continues until the green card is approved. If denied during any stage of the employment-based proceedings (LC or I-140 or I-485), then H-1B is terminated and no extension is available.

b) 245(K) Relief: Even with the exhaustion of the foregoing options, should he/she not be able to get the legal status extended, 245(k) provision should be used, which allows him/her to file I-140/I-485 concurrent filing inasmuch as the labor certification is approved in 6 months from the date of expiration of H-1B status. This law forgives out of status or unauthorized employment for less than 6 months for the purpose of filing I-485 application. He/she does not even have to pay $1,000 penalty which is required in 245(i) cases. Cabeat: Even if one is eligible for 245(k), he/she remains "illegal" until I-485 is filed and can be arrested and deported. Once I-485 is filed and receipted, he/she remains in status until I-485 is decided. This is analogous to the H-1B person who loses the job and after a short period files a new H-1B petition through a new petition. If "extraordinary circumstances" is established, the INS can approve such new petition, but until the decision is made, the H-1B alien remains an "illegal" alien and can be arrested and deported. Another example is 245(i). Once I-485 is filed and receipted using 245(i) relief, the alien remains in status, but until I-485 is actually filed, he/she can be arrested and deported.

c) Application for Change of Nonimmigrant Status: If one is not eligible for any one of the foregoing options, he/she should file I-539 applications timely to maintain the legal status until the labor certification is approved. Once labor certification is approved, one can file one-step I-140/I-485 quickly and continue the legal status and get the EAD for work. Under the law, the alien maintains a legal status pending a nonfrivolous application for change or extension of nonimmigrant status until it is decided.

Labor approved. I applied I140.
I was about to apply 485/EAD/AP for me & my wife.

I have 1 year and 2 months left in my H1B. My 6 yr H1b finishes by Apr-2005.

If I applied 485 that is AOS. I have to use AP for visting india.

can I use my H1b for visiting inida until apr-2005, if I use H1b, will there any problem to my 485.

simply ..how AP works when a person is in H1b.

You can use your H1b to visit India. That will not cause any problems for your 485.

simply ..how AP works when a person is in H1b.

If you are on AP - you are not on H1b and if you are on H1b - you are not on AP. So don't worry - AP has no role unless used. You have AP and H1b and you are using H1b - so your status is temporary worker and not AOS.

Get on flight - bye-bye.

If H1B is not stamped on passport better use AP.
 
I would say get H1b revalidated in USA. Getting on EAD has its own bunch of problems. Refer to link given by TAMIL_GC.

Only if you have no option then only get on EAD.
