Need advise please - working for small company while on EAD

I need your help.

I got a job in a company(X) that is willing to go for a contract-to-hire.
I have a friends' company(Y) which was started this month, of which he is the only employee/owner/president. Company X would be paying Y and Y would be paying me.
Can I from Immigration purposes be employed by such a small orgn. If the INS does an RFE for employment, will the paycheck fom this company be sufficient or will I face any problems. Does the size of the company matter ? Do you think I should look for a bigger consulting firm ? If you know of any, please let me know.
I have the job, I just need someone who can show me as an employee.

Please give me your thoughts.

You are fine. Only if it where to be a H1 the size of the company will cause issues.
As long as the company is registered , you get valid paystubs, size does not matter

I believe, there is a problem

Size of the company is a problem.
For GC/ labor certification employer has to prove that he triewd to hire a local, did not get one etc. ALso he has to have local employees to get from overseas.

My suggestion is to continue your H1 from the current employer (if he does not mind) and moonlight from the other one.
 
Is this AC21 case?
If so, and you are working under an EAD, I don't think the new employer is required to prove that he could not find an American resident to employ.

I totally agree with w8nc. May01 is confusing the sponsoring employer as opposed to some employer who hires a green card holder.
