Hi All,

I need advice on this..

I work on H1 and have valid VISA stamped on Passport till April 25 2005. ( finishing 6 year ).

Also have EAD and AP ..Not used EAD for employment ..Working on H1.

Wife on H4 has travelled to India.I need to go and pick them up and return.
On return, do i need to show the Advance Parole or H1 VISA while at the returning post.

Will it cause any confusion in my Status..
Please calrify

Use your H1 - show your H1 to the immigration officer when you get back here at the US port of entry. Its always safe to be on H1 as you have more options then.

You should be able to use your H1. AP will not be required. As long as you have a valid H1, you are not required to use the AP even if you have one.
I had to travel abroad recently and entered back on my H1. All I was asked was the original H1 Approval letter (which I incidentally did NOT have), but no problems anyways. So take that with you just in case...
 
Does your wife have a valid H4 stamp ?

If yes then you can come on H1 and she can come on H4, otherwise its is better for you all to use AP since the people with AP are sent to a different room for processing an you would be better off using AP for the whole family.

H1 B stamping with Finger printing now required

You can use your H1 but please be aware that they expect the new H1 stamping with your fingerprints on your passport. So you will have to go to the American consulate in India and get the latest type of stamping done. The same applies to your wife. For this you have to take an appointment in India before you leave.
As far as I have heard - after Oct of this year at the port of entry America will stop accepting the old H1 B stamping.But this is just what I have heard so perhaps your lawyer will know for sure.
So please clarify on this point and plan accordingly.

i think u r the same person who has similar dates as mine and we exchanged msgs. dont u have a 485 pending application with a ND of 10/03? If so, given the current spate of processing at TSC...u may want to plan in case ur 485 gets approved while u r out of the US (am not sure when u r planning to be out of the US). In that case u will definitely need ur AP.

Also, is your wife a dependent applicant on ur 485 application. in that case u may want to apply for her AP b4 leaving the US for the same reasons as above.

Yes..I have Ap also with till Date Feb 11 2005. ( both myself and Wife)

we are planning to return on January 30 2005.
