My EAD expires on July 26th. My lawyer did not attach 485 application docs. BCIS promptly returned the package without generating receipt notice. Is it possible to get IEAD with less than 90 days.

Theoretically, getting Interim EAD in less than 90 days is not possible. However, a few people on this board have reported that they managed to do that.

So, one of the viable scenarios for you would be to re-file the EAD application, scream on your lawyer for his/hers sheer stupidity, wait until your present EAD expires and attempt to get an Interim EAD before 90 days. If your local INS office will not issue an Interim EAD for you at that time, then take an unpaid leave. On the 91st day go back to your local INS office again and get the Interim EAD already.
 
Wonder how the F... these lawyers passed there exams. I wish u can sue this guy for his misktake and take out the damages. I guess should't be too hard . fill up the new APP asap and send it and try getting iead at different local offices u might get it . whats ur location.
One thing i learned from this place is not to trust your own lawyer does't matter how good he/she is.
 
Sorry to hear that, but you are really screwed up now.

If you researched this forum a little bit before going to your lawyer you would file it yourself with all neccessary documents attached.
 
I'm not sure if sueing your lawyer is a good idea at this point. You may, however, consider filing a complaint with the Immigration Bar. It is not an "unethical practice" per se, but if there are other complaints of the same sort, the Immigration Bar may take some action.
 
I think you should file a new G28 for some better lawyer then this moron and may be down the line think about the damages. This is something serious and if your employer is not cooprative u might loose your job for his mistake. These lawyers think they can go scot free doing anything . Atleast u need to file in a complain and do char gali meri taraf se bhi dena .. IS lawyer ke to maa ke........................

Hye Ghost,

Don't these lawyer remind you the same old poor man sitting out side the post office in village back home in India who will write a letter for illiterate person for few paise. These lawyers are noting but the same guys who fill applications on behalf of you and take good amount of money and after do nothing.

My lawyer did the same, so I screamed at her and filed it properly myself.

Anyway, technically NO .. u can't, but INS reinvented itself that if ur EAD expires in less than 60 days, u can get iEAD, but .. that rule at best is hazy. Y'know it is upto the individual INS officer's discreetion and mood.

I say give it a shot, might work.

Thanks for valuable inputs, this is definitely a wait and see scenario. Question of how I deal with that officer on that particular day of my IEAD.

SM : from where did u get the 60 day rule ... this totaly new to me.
 
Ghost, friend of mine whose lawyer is berry appleman went to get iEAD. She completed 90 days, and was told be the INS officer that your lawyer knows shit, the real rule is 60 days not 90.
 
Going by past experience, it is difficult to know who knows less, the lawyer or the IIO :). It is like the pot asking the kettle who is black!

I would rather stick to the general belief unless we have strong proof that it is not true!

As always i never trust any lawyers except one in this world ( my dad ) but there's no mention of this thing in any INS documents . I went through I765 docs of INS and only found out if INS fails to give u any verdict for 90 days of your I765 a person can get iEAD from there local office.

Do u hv any link ,,, may be it could nomal IIO BS talk too. IF we can find this on any INS website page and document it will make life easy for so many persons.
May be we can keep the URL address and charge $$ ...LOL

I am following this forum very closely since October 2002. This forum is helping me lot and I thank all the support and advises you have been giving me.

My EAD is expiring in August 2003.
If I weren't following this forum I would have never applied in March.
