need advice

I live in PA and hardest thing to do is get my ID and DL .Do I really have to wait when my case gets approved ? :confused: Case pending since 04.2003.

Did you get an empolyment authorizartion? I think that you are eligible for it since your case has been pending for 15 months. If you do, then i do not see why you are having problems getting your DL.

Well. I tried. But they said Until I dont have stamp in my passport ,( Refugee/Asylee) They cant help me.And Yes,I have my EAD.
Also in MD,OH and other states I dont see any problems to get DL.
Where I can find information about:...I think that you are eligible for it since your case has been pending for 15 months.?

Why the delay?

On a more fundamental note, why are they dragging your case for 15 months?Are you currently on a different status, like F-1 or something?

If I am not mistaken, the INS ("USCIS" is so sexy!) Regulations require the officers or the judges to adjudicate asylum cases within 180 days. Have you asked your lawyer to ask as to what is shaking?

Regarding "redneck country" PA, maybe it is high time for you to move to MD. There is a legislative proposal pending to grant driver licenses to undocumented "guests." (You know the "a" word the enemy uses to denigrate those people who work and keep this country in a running order).

Anyway, I guess some states are more friendlier than others!
 
Virginia(where I live) has passed a law where unless you show legal presence..you can't get a DL..But proof of I-589 submitted is legal presence alone!!

If you have an VALID Employment Authorization Document, you should be able to get a license without any problem.

Sorry ,I dont even know what kind of status I currently have ( status pending?) We (me and husband) came here with B1/B2 visa and 2003 applied for 589 (my husband did). Year ago we had a interview and since then we havent heard nothing.Our lawyer said to be patient and wait.
I know this all sounds maybe stupid ,but I really dont know much about this stuff.

So you were interviewed for asylum over a year ago, have not heard a decision (over 180 days), and probably (I am guessing from your earlier message) you do not have an EAD (Employment Authorization Document)? And your lawyer wants you to be patient?! Has he even applied for the EAD?

If you came on a visitor visa (B-1), most probably your visa has expired and you may be out of status. You need to confirm and be sure about it. So if the Mr. or Ms. "I am too lazy to do my work" INS officer has not resolved your case, time to get some heat on. Either they resolve the case in the Asylum Office or refer the case to an Immigration Judge.

Maybe you and your better-half should look for a new lawyer. Preferably some one who knows how to process immigration cases (hopefully you did not contract out some country lawyer in PA who cannot distinguish Guyana from Ghana!). If you cannot find one in PA, find someone else in other islands of civilization, like in DC or NY. Your should take this stuff seriously, before Ashcroft & Co. want to hold you on a material witness warrant! You never know!

My mistake ,I did not mention before -Yes we both have EADs (since 1/2004) also SSN . Fingerprints were taken 6/2003 and Interview 7/2004.
And thats all ,no news.
And thanks for advice.
