I need to change my status from F1 to HI B - I got the approvals and the I-797. A lot of what I have heard states that I must get the first H1 stamp from India. Is that true - or can I have it done from Toronto?

My F1 is valid till 2007 and I have my EAD card valid till May 2005.

What are the risks in getting rejected at Toronto? Or since I have a degree from the US - there isnt a risk?

Please let me know as I wish to do this sometime before next year.

Do appreciate any help and advice i can get.

Thanks!

Risks

If your current degree is from USA there should be no problems as documents are verifiable.

The only thing is if your job is not directly in your field of study. But this is really of a lower risk or rejection.

Delays can happen only if a security check is needed.

thank you for the reply. what are the reasons behind why they would do a security check? also - there have been a million rumors that one has to get the initial stamping done in their home country. Why is this being said if getting it done from Canada is no problem?

I guess its better to do it at your home country, because in case of delays/rfe's you have a place to go back and wait, unlike in canada, where you'll be stranded & have to return to your home country from there.. in case of any problems.
