Hello All,

I have just completed my masters on F-1 student Visa, mean time my husband filed GC and now our I485 is pending - i want to travel out of country.

Will i be able to travel on my Valid F-1 visa and re-enter on same ??
OR
Do i have to use Advance parole..

I came to know that F-1 student visa automatically invalidates when I485 is pending ???

Please help .

Thanks in Advance,
sam

I believe you are right, but I'm not sure. Be conservative - once you have an I-485 pending, you should travel on AP. If possible and to be safe, apply for AP and don't travel until you receive it, then use AP to travel. It may take a month or so to get the AP, but if you can wait that long, I would wait.

F-1 is not like H-1 or L-1. Once you file I-485 you are no longer in F-1 status and you will need AP to travel. Remember that unlike H-1 and L-1, F-1 requires you to demonstrate nonimmigrant intent, and that intent is obviously gone once you file I-485.
