need advice and help...

Hi this is my first time in joining this site. I am a Condtional green card holder,married to a US citizen. We been married for about 2 years and 9 months , The problem is our marriage is fallin apart. Do i still get deported if we get divorce? My conditional green card will be expired by august 2006. What should i do ? DO shall i go back in my country? if we get separated before my conditional green card expired.. Do i get deported? Thanks in advance i am so confused I am still living in his house i want to leave my own.

How long has it been since you got your condtional green card? When is the date when you can remove the condtional green card ?

If you divorce her before you remove the condition , then yes, deportation procedings will statrt. However, you can save yourself and career if things are so bad, by getting an H1B or F-1 so you have a status so you may not be deprted.
From my undersatnding, you are deported b/c you dont have a status as I-485 is no longer valid.
So talk to a lawyer and see your options.. which city are you in and if you could enter your timeline of your application so we on the board can have a better sence of your application.

My conditional status will be expired next year august 24, I am in New york. i have my conditional status for more than a year.

To avoid that, you must submit the removal of your conditions in the period that it should be. Both of you must submitt it. Are you separated? that doesn't count. The only situation actually that is accountable is if you are legally divorce so there is no link anymore between your sponsor and you and if anyway your spouse want to go ahead with that. The rest I think you can work it out with your spouse to see if things can be manage. Go to counseling many people do and actually many should go.

It's your life, it is a personal decision. Over this forum most of us are just sharing our personal experience and what we know. But that is your call. In my personal opinion I don't know why should you go back to your country when you still married and if you really want to make things work you can talk with your husband and work things out.

Sorry if i make you confused, I wanna get divorce. And thank you for the advice. It means a lot. But my husband told me that he wont get me deported. It just difficult living together and lost of love. Actually our fight start when he accusing me having a boyfriend. He think i am an easy person. Everytime i go out i ask permission to him an tell him where i go. HE dont have even time for me. He is too busy in his business. He always promise me to go somewhere but never come true and i completely understand him, and now he's accusing me of a thing that i did not do.

Well, you just have two ways in my point of view:
1. Try to work things out because I think there are many issues of trust and other things in your marriage that you and your husband will have to work. Apply for your removal of conditions, go to the interview and all that and then you get your unconditional green card.
2. Separate and then divorce and then you really must proof to USCIS that your marriage was enter in good faith even if you are not longer married to whom petition for you. I don't know the statistics of those cases, but you must check out these links:

I agree that therapy will be good, however, it is your personal life and I will address only the immigration issues.

As your Cond GC expires in Aug so you need to file you I-90 petition to remove Cond GC in June. I would suggest you hang in there and get your GC, as once you get it you and you hubby can get a legal divorce.

I would not recommend you go back under the circumstance until you get the GC as it will serve no purpose except complicate your immigration situation if he give you a divorce. But that is your personal choice.
