I am a research scientist in a Californian university. My university submitted a green card petition for me under OR category in October 2003. My I-140 has been stuck by name check and has not yet gone through. However, the funding for my position is going to run out the end of this month and I plan to leave because I have no idea how long I will have to wait.
I have accepted an offer to work as a research scientist in a big company (thanks to President Bush's 20,000 new quota). Jobs are similar and better paid.
What is the chance for me to continue my green card application under AC21? My university is not going to revoke the petition and will reply INS RFE (if any) by telling them the university is willing to hire me again if additional funding is secured.
