I'm on h1b visa got married to usc last oct 2005 filed I-130 and G325 with RD Dec 1,2005 and ND Dec. 6, 2005. Do I need to wait for the approval of my I-130 to file for I-485? When I looked on my case online it will take 900 to 999 days to have the decision on my case. Is this unusual? My H1b visa will expire December 2006 so I want to make sure that I have the approval already b4 it expires. I don't have money to pay an attorney so your comments will help me a lot. Please help!
 
There is no need of a lawyer unless you have special considerations which I don't think you have. You must send ALL the forms, including I-130 plus I-485 and the other forms TOGETHER at Chicago Lockbox because you are family based and immediate relative of a USC so you don't need to wait for the approval of your I-130 before you apply for your adjustment of status. You can call the 800 number and ask if you can send your I-130 receipt notice along with your I-485 packet, since you sent first the I-130 or send all the package again including your I-485 along with the other forms, read the instructions at www.uscis.gov Or make a search around this forum.

I appreciate your help but there's also other thing I have 3 kids and I'm not sure whether to file them together with my form I-130 and I485 or file them separately. I know that my usc husband can petition them they are 19, 9 and 8 years old.
