ND Oct 24, 2000 RFE issued

Hello All,
 
  I was getting frustrated listening to AVM but seeing cases closer to mine approved. But as per AVM an RFE was generated for my wife on Aug 02, 2001. Nither me or my atty have received RFE yet.

My ques. are as below:
1. How long does it take for RFE to reach you / atty ?
2. Also since it is an RFE for dependant do I get(and must respond to) the RFE or my atty must do it ?
3. My EAD/AP are expiring in Nov / Dec respectively. Do you think I should wait for the RFE receipt and reply ?
4. Also how many days do you have to respond to the RFE ? (Meaning when does it constitute that the case is ABANDONED?)

I AM JUST EXPLORING MY OPTIONS. YOUR FEEDBACK IS GREATLY APPRECIATED !!!

How about you ? you\'ve said that your wife got an RFE. Did your case get approved ? Did your wife skip any shots, I mean medicals ? It might just be for medicals & might only be a matter of time before you get it fixed. Good luck.

AVM just says " 485 received on Oct 24, 2000 ....." for my case. That is when I grew suspicious. I wish it were medical but I am sure that she and I had the same exact shots. Do you think there is something more for females ? Becos\' the doctor who did the medical exam did not say anything after seeing the vaccination card.

Hi Ramesh,

Sometimes doctors do not give the ladies the MMR shot depending on - whether they\'re pregnant at the time of the shots. But you\'ve mentioned that both of you had the same shots .. Might not be medical then .. Is she your dependant meaning was she on H4 .. Did you send a copy of your marraige certifcate ? Are the names on the wedding certificate the same as in the passport ? How about the birth certificate ? For a dependant I don\'t see anything else other than these .. except one thing .. was she by any chance out of status .. if on H4 ?

Sonme times even if the dependent gets an RFE the Primary gets approval. I would have contacted the IIO on this. I expect your approval on the way and your wife\'s after RFE\'s reply If it was other way round you were RFEd then INS might have waited for dependent\'s approval.

Dear Friends,

   WORDS cannot express my GRATITUDE to you all ! It is true that 2 (or more) heads is always better than one. As for the RFE, it has not yet been received and my atty is going to contact VSC and get it re-issued. I am trying to get through to VSC now. Will keep you posted. Also MMR was administered to my wife. Birth and Marriage certificates were also sent as part of the application. In fact we sent 2 copies of each ;-).

u should have received the notice

as per ins, you should receive the notice in 2 weeks time.
A RFE was also issued to me on August 2nd, we received it around the 8th.

EB2, India, RIR
RD: Sept 11th 2000
ND: Oct 06th 2000
RFE issued: August 2nd for last 3 pay stubs and employment verification letter confirming my date of hire, salary, present duties and job title.
replied to RFE and was received by INS on August 17th and the AVM was updated on the same day.
 
No idea abt RFE

Hello HelpUsLord ,

Neither me nor my corporate atty have received the RFE yet. This could be b\'cos of a lot of changes in my case. First my company changed attornies and then they moved to a new office. But my corp. atty says that they informed INS about the new address. She is also going to talk to VSC and get the RFE re-issued. Also do you think I should contact VSC myself and find out ?

I am IMPATIENTLY waiting as DAYS go by and I am getting to a point where I am LOSING hope. But A BIG THANK YOU TO ALL OF YOU WHO RESPONDED TO MY POST...

as per my RFE notice..

"Regulations require that the requested evidence be submitted within 12 weeks" and "You may NOT receive an extension of time in order to submit the required documentation"...which means, your clock is already ticking, speak to VSC yourself, and if possible find out if they can tell you what the RFE is about, so that atleast u can start collecting the documents required and see if they are willing to fax you the notice. Its is required to send the original RFE notice with the documentation required... and remember, all documentation MUSt be sent together along with the original RFE notice.

Spoke to a VERY friendly IIO just now

Hello All,
I just now spoke with an IIO after 18 mins of waiting. SHE WAS VERY FRIENDLY. She answered all my questions except details of my wife\'s RFE for which she said she did not have any more info on the same, but a copy was sent to my atty. GUESS I WILL WAIT FOR 1 more WEEK and move. I AM REALLY FRUSTRATED BY THIS.....

Just a note: I started off by "GOOD AFTERNOON OFFICER" and I do believe "COURTESY BEGETS COURTESY" holds good here.

Call IIO back and ask them to send you RFE at HOME ADDRESS ASAP

Ramesh, as noted in an earlier post, I was in same boat as you. VSC mailed RFE on 8/1/01. After exactly 14 days, neither lawyer nor I got it. On 14th day, I called IIO and asked her to re-send to laywer. IIO stated she was going on vacation for 2 weeks and would re-send it as soon as she returned. Then I called back again after 4 days and asked IIO to re-mail it to my HOME ADDRESS (which I double-checked was correct). After 19 days (i.e. today), IIO received RFE. I am not sure if this was original RFE mailed on 8/1/01 or the one I requested on 8/15/01. All the same, I would strongly advise you to call IIO and ask them to resend it to your HOME address, and verify the accuracy of the home address.

In my case, RFE was generated cuz the doctor forgot the check the box that states "Applicant is current for recommended age-specific immunizations" - can you believe that, one small box that was not checked, resulting in RFE.

Thanks a lot my friend. I think we are in the same boat. My wife\'s RFE was received by my original atty\'s office and they are forwarding it to my home address. It is for some "Syphilis test". So will wait for it.

Our other friend prakash was RIGHT when he ws mentioning that MOSTLY RFE would be for medical exam.

  In spite of an RFE for my wife, do you think my I-485 may get approved INDEPENDENT of my wife\'s case ? She is a DEPENDANT of mine.

Yep .. My friend\'s case was approved & his wife had an RFE. He got that cleared too.

I\'m sure that\'s all you need to do. Probably get the specific bloodwork done & get her RFE cleared. I\'m sure its just a matter of time before your wife gets her 485 cleared. Good Luck.

   As an additional question, assuming my case gets approved and my wife\'s RFE case is still pending, do you suggest I wait for hers also before going for stamping ??
