No ref. Never called IIO. Spouse and Child were also approved on the same day.
I-140 was approved for CP but applied for AOS. I sent a letter to NVC when I get I-140 approval
and informed them that I was going to adjustment in the USA. So NVC did not sent my I-140
petition to Oversea Consular Office (from AVM). I also saw some of approval in this sites which
have the similar situation as mine (which reminded me to call VSC today). It may imply I-140
designed for CP won\'t delay your AOS processing. Good Luck to all!

Hi CRSA,

My 140 is also approved for CP. But I decided to file 485 and I yet have to file it. I read ur informative post. So U want me to send a letter to NVC stating that I am going for AOS or Do U indicate that there is no such need as there is no delay so no need to send that letter

Please guide me. If U suggest me to send a letter to NVC, can U send me the format and address/phone # of NVC.
Do U want me to send this letter to NVC after filing 485 or before filing itself ?

Hi BP,

You can file I485 just as normal 485 procedures without doing anything even your I140 said it is for CP. My feeling is that it would be better to send a letter to NVC to indicate you are going to do AOS. For more information (include address and phone number), you can visit NVC web site

I went to the given URL and read that.

So U say that, only when NVC sends U a letter asking about ur choice, we can reply back with intention to file AOS. and they will hold it there until INS requests it. Did I get it correctly ?

What about U ? Have U done the same or U sent the letter as soon as ur 140 cleared for CP and before filing 485 ?

What I mean by that is, do U want me to wait till I get that letter from NVC or do U want me to write a letter indicating my desire for AOS now itself - even before filing 485.

Please Clarify.

I never receive any letter from NVC to ask my decision. You should receive Packet 3 from them very soon. I think you can wait until then ( I did so). You don\'t need to reply Packet 3, just sent a letter
to let them know you won\'t do CP. Of course, if you want, you can send them letter at the same time
when you file I-485. But make sure include your I-140 EAC number (or NVC case number if you know). If you send letter too early, they may not have your record and need to wait for your I-140. This may introduce some confuse. My case spend about one month to get into their system since I140 was approved. Also, you can call NVC officer, they are nice and helpful. Anyway, don\'t worry, I think you will be fine.
