Hey Guys,

Do you know how long it is taking these days to get GC through marriage to US citizen ??

Can I have two applications for I-485 processed at the same time ?? One through employer (which I already have going as you all know) and another through marriage .

Hi Dimpu,

Yes, I believe you can have both family-based and employment-based
I-485 simultaneously. You cannot, however, have two employment AOS
going on (for example, busband and wife each files case separately
and includes the other as dependent) at the same time.

If you file family based now, I suspect it won\'t help you much as
your EB case is likely to come through sooner than family base.
This is pure speculation on my part.

I just thought I could use the second application as a backup just in case...I would actually prefer my employment based AOS .Atleast it is not conditional , like the other one...

I had a close look in Ciba\'s list, it looks like that one would get his approval faster if he does not apply for EAD. It is reasonable because INS would assume that this guy is still with his GC sponsor, and no EAD is necessary, so no RFE or no close check is necessary.

I disagree....I have ND of 12/00 and I did not apply for EAD.

I am still waiting for approval !

IMO processing the EAD is totally independent from processing the I485. My EAD was approved very early, my GC still lingering on (RD 11/00, ND 12/00, FP 04/04).

but, look at Ciba\'s ND 01/01 approvals, most of them did not apply for EAD, and most of those who did not apply for EAD got their approvals. I should not have applied for EAD, because it is useless for me, I am oh H1.

I don\'t think so - my ND is 11/00, and I haven\'t applied for EAD and I know others who have applied for EAD and have a later ND and have already got their approval.

Hi Dimpu,

This is what I did. I had two I-485 going in parellel. One through employment and the other one through marrige. My lawyer checked with INS and said that it\'s perfectly legal to do. I got my I-485 Approval (through work) two weeks ago. So I\'ll be canceling the other I-485 as soon as I get my passport stamped.

My friend started her application April 98 in LA, and she is still waiting. It takes a long time these days. It will be even longer after local offices got bombarded with new applications via 245.
