ND 04/03/2003 RFE on Wife application

Today I got mail for my Wife application saying that they requested additional info.
Application Type: I485 , Application to Register Permanent Residence or to Adjust Status

Current Status:

On November 16, 2004, we mailed a notice requesting additional evidence or information in this
case. The notice explains in detail what additional material is needed. If you have questions
about the notice, what is required, or if 14 days have passed and you have not received the
notice, please call the National Customer Service Center at (800) 375-5283.

If you have questions or concerns about your application or the case status results listed
above, or if you have not received a decision or advice from USCIS within the projected

May be there is no RFE for your application.. I guess.. You and spouse should get your approval as soon as they receive RFE..

I am expecting a RFE as well.. no new yet..

I wish RFE is simple on as it came for derivative ( Wife ) application.

Is any one in similar situation?
Where Primary is pending and dependent got RFE.

You RD is really close to us. I have got the same e-mail for my wife also. Even I am approved but still they need more info. on my wife ??????
Did you try call for initiate case inquiry? I think your cases are at least getting touched and they are on their way of approval. Good luck!

Hi Roj86
I initiated case inquiry on 11/9/2004 on both mine and my Wife case.
I dont think the RFE is because my inquiry. In that case my LUD also need to chage and message saying that " We sent additional info you requested "


My case status no Change.

In your case you are approved. and You got RFE on Wifes application. Once you send RFE your Wife will get approved soon.


In my case as my got RFE, no change in my case, I am not sure, if my case is good to approved.... or not even touched ......

If you get RFE details let me know.....
 
no news on our case and ND is close to you all......yesterday I initiated an inquiry on dependent's case...let's see...

I think your is very closed to be approved. Since, you have your FP2 done and your RD is in the approval trend. Mine took about three weeks. Good luck.

it just happened in my case where primary (me) got approved on 11/05 and derivative(wife) got RFE today (11/16).

GOT RFE Details

Hi all
Today I got RFE details - RFE issued on Nov 16 th on my wife's application.:
Here is the RFE details:


1.Please Submit evidence that you are not likely to become a public charge. Evidence may include:

a) an Original letter of Employment( Stating prospect for continued employment and salary), OR
b) a Form I-134 completed by your financial sponser for which your sponser must comply with the instuctions of the form, OR
c) Other evidence(Bank letters,etc)

2. Submit an original leeter on company letterhead from your principal's current employer stating date of hire, duties,remuneration and prospect for continued employement.
3. Submit evidence to demonstrate where you and yours principal spouse are living.

This the RFE.
FYI :I am the Primary applicant and my wife is dependent.

I think insted of issuing two RFEs for me and my wife, INS included all in one.

As I know,
1 a) I can not provide EVL for Wife

I can submit 1 b) I 134, C)bank stmts
(2) - EVL
(3) Lease agreement papers, where it shows both names on it.
These all I am thinking to submit.....

All, please post your comments, If you think ,I should provide more documentation for this RFE other than listed above;

I have got my wife RFE yesterday too. I was lucky that It was my wife Medical only. Since she was pregnant and did not complete chest X-Ray and TB skin test. We have to start over the medical for her again.

Skota, I think that should be sufficient, however, I think copies of utilities bill or credit card that have your wife name and address might do it too, my 2 cent. Good luck.

I would think it unlikely that USCIS clubbed two RFE details into one and sent out in the name of your wife. If the RFE has your wife's name, her A# and her I-485 EAC number, then it is intended for her. So when they ask for the EVL, I am assuming they are asking for her EVL (I understand that if she is not employed then it might be irrelevant but the USCIS does not know that)
My advsise would be to read thoroughly through the RFE again. In our case, we received two separate RFE letters, one intended for me and the other for my wife. The one for me asked for Marriage certificate, the one for her asked for EVL and Medicals, she is the primary.
Just my 2 cents..

RFE is on my wife name, with her EAC # and A#
I gone through RFE several times.

ANS: As she is not working and dependent, I can not submit EVL for her
b) a Form I-134 completed by your financial sponser for which your sponser must comply with the instuctions of the form, OR
ANS: As I am the financial Sponser , I can submit I - 134 form
c) Other evidence(Bank letters,etc)
ANS: Bank statements having both names, so I can provide. I can take a letter from Bank too.Showing the both names and showing average balance or as of date balance

2. Submit an original leeter on company letterhead from your principal's current employer stating date of hire, duties,remuneration and prospect for continued employement.
ANS: As I am the Principal, my company will provide this letter
3. Submit evidence to demonstrate where you and yours principal spouse are living.

ANS: Lease agreement


What I understood from this RFE is, I need to prove that Once my wife get's GC , she is not going to become a public charge..... like applying for unempolyement benifits etc.....

Thats why they asked EVL for her, if not EVL, then I 134, bank stmts....and My EVL.... need to prove that still we are together......

Who received the RFE letter -- Your lawyer or yourself
I was approved but my wife just got RFE but we are waiting for the letter for 1 week.
