NC cleared

Just spoke to Texas IO, he confirmed my NC is cleared and they received it sometime in Oct2007 (didnt gave me the date). He also mentioned that my case is with the officer and should hear something in next 3-4 weeks (which I doubt because my date is not current). There is no LUD on my case.

I am going to confirm this info by calling again and by taking InfoPass.

By the way, did you take any actions in tems of clear your NC?

Today I called texas IO and confirmed that my Name Check has been completed, now they are waiting for my priority date (which is Oct 2002) to become current, lets see what dates we will have on December Bulletin.

Any predictions?
 
Three times last 2 months month I went to local USCIS office and talk to IO officers they all told me that my name check has been cleared as of 05/30/2007.

But it has been 5 months have not heard anything from USCIS yet.

I dunno what are they smoking these days.....

I have to call back to TSC to see if my NC is cleared after two months.

You had better to call USCIS center to find out what happened to your case. I know a friend who had not heard any result after the processing time was 6 months ahead of his PD, after he called USCIS to ask if his case was forgotten, then the center replied they will take a look. A few weeks after the calling, his case got approved.
 
I called USCIS about every week from last 4 months or so after I heard my name check has been cleared but got two letters saying still pending due to background check......

On top of that my 3rd EAD application has been pending for more than 4 months now......I called yesterday and initiated Service Request......

I dunno what else to do......already sent a letter to local congressman who publicly posted on his website that he wanted to control immigration both legal and illegal, to Laura Bush and Ombudsman office.

Any idea what I can do to at least expedite my EAD applicatoin
 
Saw your case details, timmings are similar to mine. Any progress yet. I am from retrogressed country for my EB-2 while for my EB-1 case my visa dates are current but since I filed my 485 in Feb 2007 so they are not touching my case, although I got letter from FBI that my NC for both my EB-2 AND EB_! applictaion had been cleared. This was after intitaing FL inquiry.
Do you think anything can be done to ask them to process my case before prcessing dates are reached. I am just waiting for nothing, even my FPs are current and seems to be a vicitm of TSC processing dates which are moving back and forth several times during last several months.

As I know USCIS generally, but not always follows the first-in,first-out rule when your PD is current. When PDs are current for certain Eb1~3, there is no big difference between Eb1, Eb2 or Eb3, the RD will be dominant. Sure there are a lot of EB3 and EB2 with current PD and earlier RDs than Feb. 2007, so I guess you could wait for a little while before you take action.
 
Well this issue had been debated several times and I still think still more people have several different opinion. For a 485 to get processed most people believe that it is RD not PD that they take into consideration. WHile you believe that PD is something they care for. I still believe that based on their way of processing cases even though one has a current PD or available visas (current) they still got an excuse to say that "you are still not in the published processing dates for 485" I am therefore hesitant. Thats why seeking opinion from people around before intiating something. :) Thanks :)
