NC cleared and case has been assigned to officer, Please give some thoughts

Dear Friedns,

Today I got letter from Senator office saying that my name check was completed on 10/09/07 and file has been assigned to officer. I hope this is correct information.

Problem is now my PD is not current, do you think my case will be approved before my PD becomes current or do I have to wait until my PD becomes current.

I appliled on EB2-NIW on Jan 2005.

Friends, please give some thoughts about it.

Your case will be approved only when a visa number is available - in order for this to happen, yes, your PD needs to be current.

Thanks for your reply. Are there any visas available for EB-2 India. I would be glad if you could give some information. There are many people (EB2-NIW) who got approved before their PD becomes current. But I don't know I am that much lucky enough

I was told my NC is clear and waiting for the PD to be current to be assigned to an officer... this is the way they work?

not sure of PD applies to NIW cases

I am not sure if NIW cases are affected by retrogression of PD.
Check with your lawyer or wait for some experts to speak up :)

Of course it is. NIW is under EB2, so it is affected by retrogression. Any category can be affected by retrogression for that matter.

Yes, probably your NC information is correct if it is coming from the senators office. you can doublecheck by calling TSC using the POJ method. The IOs are helpful nawadays in giving this information.

However, about getting a visa# without having PD current...i'm not sure. It is possible that they have assigned a visa# before it was retrogressed. then there's a chance. I was told today by a IO at TSC that assigning to an officer not necessarily means assigning a visa number. Looks like your PD would be around 01/2005, if that's correct and you are from India then PD was not even current in Octber. So I highly doubt that you have a visa#. Also, can you show me the cases where I-485 was approved even if the PD is not current... that goes against the USCIS norm! Are you sure you are not getting mixed up with ROW people?
 
ManwithNoname , eb1a have told you the scenario clearly. if you are looking for a favorable answer, then yes, you will get it when your PD becomes current :)
