Name Problem Need Advice

I am almost at the end of my long 6 year ordeal, but there is one problem. My father is the one who petitioned for me, but he is my step father. When it came time for the interview I we had a problem. The name that was used on all of the forms was not the legal name that I had on my birth certificate that I had sent in. I was able to explain the discrepancy since I was using my Christian name instead of my traditional first names. I sent them the records but the only problem was my last name. My father never legally adopted or changed my name. They then required me to take a maternity test with my mother, which of course came out 99.9999%. I have submitted all the proof I can possible find to show that I am who I said I am. My only question is if I should go ahead and change my last name now and send in the name change form. I am worried it might look shady that I am just getting around to changing my name, I am also worried that they might still deny me if my name is not legally changed. I am sweating bullets what should I do?
 
You need to look at the "law of the land" as it controls the issue of a stepchild assuming the surname of a stepfather. Many family laws do allow it. You need to do the legal research and spell it out. IF you cannot support it with legal references then you may need to get as formal legal name change.

How old were you when your mom married your stepfather? When and where was this? What is the story with your biological father? Is he deceased? Did they never marry? Was he "unknown" in the records? Did he abandon you both? All of these can be crucial factors.

You may need to contact a "family law" lawyer.
 
My parents got married when I was 5, my mother divorced my birth father, and I have not spoken to him in about a decade. My parents got married in the United States. We have all the documentation to show he was married to my mom, baptism certificates, and birth certificates, I gave all of this information to USCIS. The USCIS only wanted my mother and I to get a maternity test which showed 99.999% that she is my mother.
