Name Mismatch-Urgent

Hi,


I filed recently N400 Form and is scheduled for an interview next week.
On the Form, for the question : if you have used any other names? I have left blank.But duing my GC process, there was an RFE asking for details around the correct name as people have swapped my first name as Last and Last name as first and sometimes split it with a middle initial. My attorney responded back with the correct first name and last name and i have it corrected ever since.
My Green card has the correct display of my name though..

However my question is should I disclose it during my interview that people have swapped my names sometimes and some of the certificate like Marriage certificate has a different name on it? I could say that but am worried to have not mentioned on the form.


I would apprecite for your expert advise / thoughts / suggestions around this as how this can be handled..

It depends: if the other combinations/spellings have been for offical business documents/communication: employment, insurance, title, bank statements, DL, school records....or others used for the same purpose. I think you should disclose.

My bank statements, GC, DL,employment record, W2, tax returns, and school records are now showing the correct names. I corrected the same during my i-485 as per my school certificates.

But My marriage certificate and court documents(divorce) says the old mismatch name.(these events happended before my GC approval)

I can disclose but If I disclose ( if you have used any other names) during the interview and not mentioned in the form, is it going to be an issue?

You'll have to disclose it. The interviewer probably will ask for the divorce decree, and they will see the mixed up name. They'll probably also see a copy of your marriage certificate in the A-file.

If the interviewer is doing their job right, this should not be an issue, because the FBI name check already runs searches based on all possible orders of your names. However, there was a case on this forum not so long ago where the interviewer said they're going to request a new name check because of the different ordering that was revealed to them in the interview. But that's better than being accused of attempting to hide that information.
 
Agree with Jackolantern....Correcting does not count...There is a reason that USCIS asks this question. Just imagine "bad guy" does crimes then goes and changes the name to hide....his actions.

You may expect some delay...as most likely USCIS will need to send your name combination/spellings to FBI name check again.

Trust me, disclosing it is safe...do it a right way during the interview once you have done with Civic/English test...During my interview, IO went thru my A file and highlighted some discrepency between birth certificate spelling and passport version...I had to explain entire thing and IO had to go and check with Supervisor before proceeding...

I was interviewed in the last week of jan, 2010, passed the interview but the officer told me that I cannot take the oath becuase he needs to request for a name check using my maiden name(name on the green card). He said I should get my oath letter after about 30 days. I'm expecting to get my oath letter last week but I didn't get it. Not sure how long it took to get the oath letter for the case you mentioned. My DO is Mt. Laurel, NJ.

Infopass/Phone call to USCIS. They may just need a little prodding.

(you should have listed your maiden name under other names used. After all you did spend a sizable part of your life with that name)
 
Hi Gungadin. I actually listed my maiden name on the application form. Not sure why the name check was not done before. I will try to call or infopass. Thanks!
 
Hi, I just came from my infopass appointment. The lady I talked to just said that my case is still pending-did not give me any additional info. She said I should just wait for the oath letter-they will send it once it's available. I asked if I could talk to my IO but she just gave me a form where I can write a note to the IO. She said she would give it to the IO. Do you think it will work? Should I do something else, or just wait?

That's the IO being stupid. Your maiden name was on the green card, so there was no need to request another name check, assuming that you listed that name in Part 1B where it asks for the name that's displayed on the green card.

However, your interview was only two weeks ago, and most people without any such issues have to wait a few weeks for the oath letter anyway if they don't have same-day oath in their location. So at this point we don't know if the name check has anything to do with the reason while you're still waiting. Don't get concerned about it yet.

OK, I see that now. I was looking at your March 8 post without seeing your earlier post about being interviewed in January.

Unfortunately, you don't have much leverage to push them to do anything while it's still less than 120 days since the interview. If you contact the Ombudsman or Senator now, they're probably just going to say the name check is pending and you need to wait another 60 days or 90 days.

If it reaches 120 days after the interview and you're still waiting, make another Infopass appointment, and when you're there remind them that it's been past the mandated 120-day deadline. That sometimes makes them take action and send you an oath letter within a couple of weeks. If that doesn't work, prepare to file 1447(b).
 
I have a good news! I just got my oath letter today. It was mailed yesterday - a day after my info pass appointment. Not sure if my inquiry during the info pass helped. Thank you for your help!!!
