I am running on 7th year H1b & my spouse on 1st yr H4 with me.
We filled an H1B/H4 Transfer & the lawyer used too technical way of putting together my spouses name & the person approving the application used exactly the same words on the approval.

Lawyer used my spouse name as: "'Last name' nee 'Maiden Last name'", "First Name"
The Approval notice also have her name with this format.
Where her legal name after Marriage is just "Last name", "First name".

I have requested the lawyer to get it corrected but he telling that it may be allot of trouble & the name is ok.

In couple of months we have to go to Canada & to come back we have get out latest Visa stamped.

Please let me know if anyone has come across this type of name issue & how to rectify it? Or if it ok to keep the name as is?

---- if her name is same as on her passport then I dont see problem

No they are different.

Name on Passport (before Marriage) was: “Maiden Last name", "First Name"
Updated Name on Passport (after Marriage, on different page) is: “New Last name", "First Name"
Name on H4 approval is: “’New Last name’ nee ‘Maiden Last name’”, "First Name"

The lawyer says “nee” was used in the application to tell my spouses Maiden & New last names but the approval was expected to have only the “New Last Name”

Update for those members with above issue.

My lawyer called up the INS office & explained the issue. They fixed the name issue & sent out the updated approval document with in days.
