Name check

Hello,

My brother's name check is in pending since last 2 years. His wife (who is US citizen) appllied for his green card and it has been 6 years all together and he is still waiting for his green card. He has written many letters to US Senators, US Reps, FBI and to local INS office but there is no news about his green card. Local INS officers tell him that we are still waiting for the FBI clearance and when my brother talked to FBI then they said that they we have sent the clearance.

Anyone has any info why it is taking that long to get the clearance from the Home Land Security? My brother's attorney is #4 in the Texas and his firm also has written many letters to local INS but luck so far. Please let me know if anyone has any updates about the background check. Thank you.

He should file a writ of mandamus. They will make a decision in few days or weeks. Calling senators and congressman is of no use.
 
What is mandamus? Could you please give me the details along with the address and telephone if you know. Thanks.
 
Writ of mandamus is a petition filed by your lawyer. Just search for it by typing in the words in this forum. It is basically a case against uscis compeling them ot make a decision. You should talk ot your lawyer for more details.
 
Is there anyone else who is waiting for his/her name check clearance for over 2 years? Why some name check are cleared in 3 months and why some name check are stuck? Anyone any idea?
 
GO TO FBI WEBSITE and under search tyoe NNCP you wil get testimonies that will tell you how it is done and why for some it takes longer.
