I don't think it would take long, but I submitted one earlier this month and not getting a reply. So I called them this morning and was told that mine is not done because my name check is pending, they can not take files away. I wanted to see my records because my name check has been pending since Dec02. I'm really curious to know why it took them so long. It's totally ridiculous for them to take so long to clear an innocent name. It's completely a waste of time and resource for them too. If they are not holding my case back, I really want to laugh.
 
I can not agree you more. My case is even worst: RD June 2002. Just assume CIS requested name check 6 months later, so it's been 2 years for name check. Just too ridiculous!

I submitted FOIPA early this month and have yet to see a response, so I am going to call them. Which number I can reach them for FOIPA inquiry?
 
I talked to them just now regarding the FOIPA. Got the same explanation that as my name check is pending, they can not do FOIPA as FOIPA and name check hyper each other and for the obvious reason, name check is more important. God Damnd. Everybody know that.
 
i tried to take all the time it goes to answer machine.
when is the right time to call and reach a humanbeing?

Hi, Guys:

Thank you for such good ideas and we all agree that we have to do something. I have written letters to two senators of my state and my congressman. let us talk to the attorneys wha is the process to file a law suit. The points are:

1. Taking more than two years for name check should be a shame: Which Government has such a low efficiency? Even the third world countries are doing better?
2. Will the real bad people care about green card? Will they wait for two years to do some bad things?
3. If you waste too much time on the good people, you can not focus on the bad guys. Of course, you can ask how can we know you are good people? Well, in that sense, We will never approve a single people is good in this world until his life is end!
4. Under the name of security to let the hard working people to suffer is the abuse of right. It is NOT fair!

Guys, let us do it. We can not suffer any more, tow years is too long!

I AM STUCK AT "SECURITY CLEARANCE"--same as name check?

All:

I contacted my congressman, and after his inquiry, USCIS told him that

a) they are not processing applications for I-485 after June 31, 2002 (which is B.S. because they obviously are) and

b) my application is going through security clearance. So I am stuck there.

Count me in if you are all interested in filing a class action lawsuit.

In the meantime: flood your congressman's office with inquiries. Send emails, calls, faxes.

I will also write to the President, Vice President, and anyone else who might listen. If we start being proactive and speaking out, maybe we will start being treated as human beings.

Hi all,

Mr. Khanna has already filed a class action suit against USCIS. In this forum all the court hearing documents are available. You may read them. There the divine UCIS has given the most grotesque explanation vis a vis this name check system.

For DV lotteries, USCIS can finish name check, security clearance bla bla all in 4/5 months. How can they do that so quick? Does lottery winners pay them bribe? The lottery winners are the most unknown among all. USCIS can issue them green card in less than one year!

On the other hand people who are here going through different processes like, I-129, labor certification, I-140, EAD etc, they are being checked everytime. Yet they are kept hanging for years in the name of so called name check and security clearance??

DV winners offer nothing other than luck. They are chosen from among the wilds. They never paid taxes, never contributed to the US economy. Yet they get green card in less than a year?

People who are paying taxes every year here, demonstrated respect to this countries laws are made to suffer!!

There should be some limit to the level of stupidity and unreasonableness.


One more point. Does it not show the incompetence of this USCIS that they can't decide if some one is criminal or not in two months instead of two years?

Suppose after 2 years they decide some one is criminal. Then they have allowed this criminal in this country to do more crimes for two years giving him EAD, AP etc. What kind of nonsense logic is this? If you want to make this country criminal free then take them out in the quickest possible time. You may not keep them here for years with EAD!!!

I guess the dumbest agency in the government is the USCIS perhaps run by some mentally retards.

I can't agree more with you and thanks for such good points. let us write letters to Senators and Congressman and bring all of these points to them, weather they listen or not. Also let us some how united to speak out our voice.

Poeple's rewards shoud be based on their contributions, inteligence and performance, not by luckiness. I always try to do my best to my company and this country, I cannot believe they purposely let us suffer. They treat us even worse than illegal immigrants.

Do you guys really know what 'Name Check' is?

How does one know if his file is stuck in name check process?
Is it that if there is someone with no movement in the file for 2 yrs, then they start whining automatically that name check is the reason....?
