Name check stmble AFTER the naturalization interview

He verbally said - "I recommend you become a citizen. But - one thing...- name check...
Piece of paper of course says: "A decision cannot be made at this time. Below - FBI namecheck pending." Quite interesting - the officer interviewed me had a HEAVY spanish accent,
I had HARD time understanding him! :rolleyes:
Can I claim if in the future something happens
(God forbid!) that I did not get him right because of his accent? :)
 
Thanks. I think maybe he was just being nice saying that he's 'recommending you for naturalization', or he was just bs'ing. In case you aren't aware of this : some people get told that (that a decision cannot be made because of blah blah), but they get a oath letter within a month or two afterward. So hang in there.. and good luck.
 
USCIS Are Good, FBI are a BAD PARTNER

People take it easy, I can tell things start to move faster with background checks. I have seen many people getting cleared after name check pending for few months. I am one of those people, my naturalization stalled for couple of month due to name chack and a decsion could not be made, but recently got oath letter exactly two months after interview.

I always thought that USCIS are very good in their timing, their problem is that they have a bad partner who is the FBI. When a background check is stalled due to FBI, USCIS can not make decison untill it is cleared. I wish there was a section to sue FBI rather than USCIS. USCIS has been taking the blame for the FBI, they work their fingers to the bone with FBI to get things moving. There are rumors that INS promises to clear all application stalled by background/name check by September, they are helping the FBI do that...man people confirmed this rumors but no official saying to it yet.

Good luck to all of you, my sympathy to all those undergoing the wait to clear checks, I was in it and didn't enjoy the wait a bit so good luck again to all of us.

USCIS never admit their mistakes. though it is in American, ttheir behave like like those bloody wicked communists.

I am sure if one day they want a baby while their wives could not get pragnant, they will also blame FBI for not doing the jobs for them.

okay guys please tell me if i go for my interview and they dont have my namecheck then i can sue in 120 days?? what are the odds that they are scheduling interviews without name check.
 
if it was the namecheck, why did they gave me an interview before it. My issue is different, "my current address problem/ the one I put on the application". Thats why they are doing background check again I guess.

In any case I am not that sure what they are doing. I might call them and find out whats going on, its better than taking a guess.

The really really sad part is that I have to fly back eveytime they needed me for some process, you know its my fault/fate but it all comes down to my financial situation and with the help of god some positive results will come out

Name check or whatever else, you should seriously consider suing them after 120 days from the interview.

You can do it Pro Se (by yourself with no lawyer) it's not that complicated.

In this particular instance FBI is the one who stalls the processing.

But why USCIS doesn't request an expedite name check...unless they are sued???

Overall, USCIS is a very bad institution, and this single example with FBI is not relevant for USCIS "modus operandi"

There are 1001 examples where USCIS doesn't have a scape goat to blame for their own failures.

U did a great job twisting the meaning :) . I am sorry if you had a bad experience with INS but let me tell u something, FBI is the worst organization in this country, we both know that they are the origin of the problem. I haven't seen but one or two cases where a background check was cleared and no decision taken by INS, for the most part, checks are stalled at the FBI, INS are happy to get done with as many petitions as they can, FBI was given a big budget to enhance it's technology and speed up the screeing but they keep asking for more, it's been over two years now and everbody can tell no improvement has been observed. Of course I am not saying INS has the smoothest processing ever, there have been occasions where some unlucky ones were subject of human errors like misplacing a file, duplicate alien number etc..

My interview was on feb 2nd. I didnt count the days and stuff but I called up USCIS on May 31, technically 2 days before the completion of 120 days. They told me they will reply me in 30 days. Got a reply on June 13. 131 days after the intewview.

so will I be able to sue if I am considering that option?

As of today you can sue them anytime you want. The 120 days have passed.

You fabricated the fact. FBI may not be good, but USCIS is definitely the worst federal department in the country.

You are glorying USCIS like those North Koreans' glorifying Kim Jung Il, or those Chinese glorifying Mao ZeDong during cultural revolution.

Don't even think about it! Before you have your oath you're still just a permanent resident.

Is it FBI's fault if after interview, decision cannot be made due to missing file? Is the missing file due to FBI sending someone to USCIS to steal the file?

If it is not FBI, is it the applicant's fault for the missing file?

Interview Feb 23, passed but no decision made due to "missing file"

Multiple inquires into USCIS National Center but got nothing. Customer Services Representsives there were just bullshiting, each time using a different excuse not to answer the query.

Around May 20, took infopass to Boston DO. Was told "everything cleared, to be sworned in in a few weeks, should be sending oath letter in 2 week".

Got nothing, so made another ifopass yesterday. Was told again that "everything cleared and would schedule an oath ceremony for you soon". When we asked how long to wait, the lady officer asked us to wait for it patiently yet she was so impatient getting herself testy.

If everything has got cleared, normally how long should we have to wait for the oath letter? We do not know exactly when "everything" was cleared but let us assume it the worst case that it was just one second before we visited Boston Office in May.

Anyone with that experience or visibility into Boston DO?

My questions to you are:

1. Is it USCIS or FBI's fault for missing file?
2. Is USCIS doing a good job when you cannot find case staus on the web, and if you call National Service Center they try not to answer questions with all excuses each time contradicting to each other?
3. Is USCIS doing a job when they said one will be scheduled to take the oath within 2 weeks, but nothing happen? And when we check with them agian they just ask one to wait even though everything is cleared?
4. Is an applicant has to suffer due to the inefficiency, incompetency an impotency of USCIS?

I agree the case you presented above is INS fault, remember I never said they are perfect. It happens sometimes but not quite often when they mess up due to missing file etc...but the odds for this to happen is like in 1 in 100 which is a good number considering millions of outstanding petitions...Let me just say that people who come to the forum are usually the unlucky ones, millions of other applicant don't bother to hang around here because everything went smooth for them with USCIS.

Don't worry your case would be taken care of and all this hate will transfer to love when they give you the good news in a USPS letter to be arriving soon.

How do you find you latest case status online(after you passed the interview, but no decsion has been made).

I put the reciept number and it was showing the filing date, file type:N-400 and stuff, but when I click on the receipt number hyperlink, it give me this:

I called up the NCSC and they just gave me basic information that I already know. They didnt even look up my case at all.
