FBI name checks, one of the security screening tools used
by USCIS, may be the single biggest obstacle to the timely
and efficient delivery of immigration benefits. The problem
of long-pending FBI name check cases worsened during the
reporting period.
• As of May 2007, USCIS reported 329,160 FBI
name check cases pending;
• Approximately 64% (211,341) of those cases have
been pending more than 90 days and approximately
32% (106,738) have been pending more than one
year;
• There are now 93,358 more name check cases
pending than last year, and 31,144 FBI name check
cases pending more than 33 months as compared to
21,570 last year;

Do you know if this is only Employement based or this includes family based as well? I really doubt there are so many 485's employment based pending
 
I dont think there is a distinction or prioritized queues based on categories....... for USCIS security is same for all..
 
Scary $hit. So, now when they open up new visas in Oct. The people who filed in 07 and 08 will get approved before us. And then again the visa#s will run out. And another year comes, even if our NC's are cleared in the meantime..they are expired and USCIS requests another NC. In the meantime FP's expire, even if the NC clear in time(Unlikely) they expire again by the time your FPs are done. When will this Bull Crap end? IF YOU ARE CAUGHT IN A PERFECT STORM YOU ARE SO FCUKED.

That's assuming that everyone who applies in 07 and 08 have their NC cleared within days, which doesn't appear to happen in reality. From the stats, it seems like the majority of the NCs get cleared in 3-6 months. You have till then to pursue this matter further with your Reps from Congress as well as with FBI and USCIS itself.

There is no clear evidence that NCs expire and require to be refreshed every so often. Unless we get confirmation on this, we should keep this only in the realm of possibility, not in the realm of certainty.

Having said all that, the basic problem is one of demand/supply. There are far more applicants than there is quota. Unless Congress fixes this with new laws, some people are always going to get screwed, even when nothing is pending in their application. The only thing "pending" then will be a visa number.

According to FBI, they receive 62,000 Namecheck requests every week and they clear 90% almost immediately. If we are one of those who is stuck, it means that the people who applied later will get approved sooner. USCIS just won't wait for our results to arrive and hold other applicants.

... with over 27000 from the USCIS. That's about half the requests they get.

While they "return" results immediately, USCIS doesn't say whether it updates those results immediately. It's not as if FBI places the namecheck results directly into a USCIS database.

In any case, I understand where you're coming from, and the only real solution to this is to get Congress to do something about it, by talking to some Representatives about real experiences and the effects it has on the lives of the affected applicants. Unfortunately, most of Congress seems more interested in talking about illegal immigration and somehow trying to bundle it with legal immigration, leaving us in the lurch.
 
I remember reading somewhere on this forum that FBI does respond to USCIS upon clearance. The thing is that FBI contacts the "main" CIS office somewhere in D.C. and then it takes about 2 months for this response to reach the service center. Then, of course, there is a possibility that this response gets lost depending on circumstances. But definitely they do respond. So it's a "push/pull" protocoll, so to speak, a crappy one, it does not work to the fullest. If FBI did not respond at all they would probably be busy just processing court orders the whole time, because they have clients more diligent than USCIS and they would be sued constantly. This is my 5 cents. And yes, it's absolutely necessary to keep the bastards on their toes and constantly make congressional inquiries on the status. I just sent a second letter to my dearest Laura Bush.
