Name check question

Folks,

What is the earliest possibility of the name check being cleared? I have been reading that it takes 600 odd days. Has anyone got it sooner?

Please enlighten me on this.

I have reached a stage where I have decided to quit this process since its so stressful. I really dont have any energy to pursue if my case has indeed gone into name check.

The answer is it all depends. The name check process is initiated when processing your 485 and these days to just to get to your Name Check itself is taking a long time. Some people did have some luck in clearing the Name check in less than 4months while others have been waiting for years.
So in short, if your ND for 485 is before 2003 you should contact your congressman immediately to just atleast enquire but if it is after 2004 then you need to get in line :) .
 
2003 FBI congressional testimony

According to FBI's testimony in congress, July 2003:

85% of name check has no "hit" : takes about 72 hours.
Additional manual check with no hit : (additional 10%) : in 1 week or so.
So 95% of cases can be cleared within 2 weeks, I guess.
This is purely a processing time and there is waiting time.

So their guideline as of 2003 was : 86-92% are completed in 30 days
and 98-99% in 120 days.

They're saying you're in trouble only if your case falls into this 1 %.
I somehow thinks it must be bigger than 1 %. At least, the stats
among my co-workers suggest it's more like 15-25%.
Well maybe me and my co-workers are unlucky.
At least, I think it's much slower than 2003 FBI testimony.

I beleive lot has changed after 2003.
I was told that name check also depends on country of applicant!
but yes moral remains same...1 day to 3 years
 
so the summary is that contacting or not contacting a Congressman doesnt really matter much these days.

Also, if there is a name check that has been triggered after FP is that a different one?? I am so confused.....please clarify.

FP and namecheck are two processes done in parallel for everyone.

but i read that for namecheck the people are chosen randomly. Is that a different namecheck? Please clarify.

Everyone have to go through both namecheck and FP. I never heard about anything done randomly in USCIS, prolly you misheard something

Everybody must go thru name check.

One thing unclear is the time when NC is initiated.
USCIS usually refuses to disclose info on the time of NC initiation.

For some cases, NC get triggered right after 485 RD.
Some suggests NC actually gets initiated after FP is done.
My lawyer believes the later is the case for most of people...

How did you know your status is name check? I have no idea where I am at now.

Every AOS application has to go through Namecheck and some get stuck in the FBI queue. The name check request in my case was sent just after my 485 RD (per USCIS).
If you believe your name is stuck in the FBI queue, you should start calling around (USCIS, Congressmen, senators) to make sure it gets some attention. You don't want to be in a situation where the visa numbers are available for a short period of time and you are stuck in the name check queue.

I got this reply from USCIS today:




Your case cannot resume processing at this time because according to the
Dept.
of State's visa bulletin,a visa is not currently available to you. We will
continue to monitor the visa bulletin on a monthly basis and will complete
the
adjudication of your case when a visa becomes available.


What does this mean??

Please help with your inputs.

I am EB3, PD: April 2001, 485 RD: JUNE 2002
