Name Check Problem FBI and USCIS Don't Agree

I had talked to VSC representative who said that they had sent a name check request to FBI on August 12th 2004. Yesterday I got a response from FBI for an email I had sent on October 20th 2004 saying they have no record of a request from USCIS.
Am I stuck in this limbo, what can I do now? I don't know if this is the curse of the March 2003 filers but please let me know your thoughts.
 
May be contact a VSC rep again?

One suggestion is to contact a VSC rep again, explicitly inform him/her of this inconsistency, and see what he/she has to say. At the very least, it should hopefully alert VSC officials of a potential problem.
 
I would not pace much weight on what the FBI says. The same happened to me where the FBI response was that they had not received a request at all. I received the approval about 15 days after the FBI e-mail.

That is good to know Mparth. I had assumed that it would have been the USCIS that had screwed up. For my part I am going let the senators office that has been helping me to see what they can do to help the situation.

Will tell you case info (word for word from your case status page)
Press 3 to continue to next step after listening to your case status message
Then select option 4.

If you had done a case status inquiry in the past you may get "Temporary problem" message that your case cannot be found. In that case use your spouse's case number to get through.
Don't ask for your case status when connected. Tell that you are afraid that your case and your wifes case may have gotten separated.

Name check may take a day or a week or a month . So It is possible that
After you got FBI's response saying that they never received a request from VSC for your name check , probably FMI must have received namecheck request from VSC and they must have cleared and VSC must have a approved your case .

What I am trying to say here is : FBI is right when they say that they have not received namecheck . VSC -FBI name check communication channels are broken (especially for Q1 applicants of 2003).

What needs to be done is : Let the VSC know about the problem by calling them , by faxing them , by making congressional enquiry .
Apparently VSC knew this problem. It is that they are busy approving 2004 cases .

Guys,
I sent an email to fbi to check if my name my name check is cleared. I did it two times in last 3 months but I have not received any answer from FBI. Is that mean my name check is not done or any problem? If anyone else in the same situation??

I had sent my email to FBI on 10/20/2004 and I got a reply only on 01/21/2005. My guess is that you will be hearing from them soon. Just check you junk mail folder - just in case it gets delivered to it.
 
I agree with mysunny007. I think after you called VSC MParth, USCIS might have intiated the name check and they it might have got cleared in a day or two. But again nobody on this forum can exactly give the correct solution to this problem and there is a thread by rajudm Name Check Issue and it will give some more details about this issue. Please see one of my post and I have posted the problem between FBI and USCIS.

Thank you geemboomba for directions to reach a vsc rep.

My case is similar to needhelp and, others in this thread. The rep. told that they requested a name check for me in sept'04, but I got a reply from fbi that my name check request was not received from uscis, for that the rep said, they will forward the request to some dept in washigton d.c and, they will inturn send the request to fbi, that's reason fbi didn't have my request. That's not seemed a convincing answer, but it appears that we have to wait in this limbo.
I haven't yet contacted any senators, may be I'll do that soon. Meanwhile I waiting to go to a local uscis and, see what they have to say. My attroney thinks getting another fingerprint would make the case going forward, which he suggested to get it by visiting local uscis office
 
Today I talked to VSC representative. I was surprised that they keep a record of all our calls. She was able to tell me when I had last called. Anyway she said the problem with FBI not getting the request was well known and that all these cases were being placed in a "manifest" and sent to their headquaters in Washington D.C. and that she could not give me any time frame. She also told me to call every 2 or 3 months to check on the status!! - Every 2 or 3 months!!? So how long is this going to take?. I just hope I hear better news from my senator's office.

What is this damn manifest ? Is it a single file containing all pending namechecks ? When did they send it to Washington DC ?

Sunny I have no idea what this "manifest" means. But she did say that all cases in a similar situation (FBI not receiving the name check request) would be there in the "manifest". I have written to my lawyer to see if he knows anything about it.
 
Ok. Now I understand why some of our Friends are getting emails from Mr.Hardy's office as the results were done and sent to the Washington DC.

I think we are here for a long wait if we really don't do anything seriously. So lets get together in the thread which Rajudm has created and try to come up with some solution soon.

Sure!, lets get together and, find some way to get out of this loop.
I'm thinking of writing letter to obusmon (not spelled right) office in d.c. I think this should be done individually, as they require special declaration.
Also, anything that can be collectively done!
 
I think we should try to correspond in this thread Name Check Issue so that we know who are all affect by this and I am talking to my congressman about this from long and we all can point a link to this thread in our letters and show how many are really affect by this issue.
