Name check pending ? this may be a hope.

Struck Struk Sucks

I called IO today and she said Name check is strukc so they can't do anything and also IO said it will take 1 or 2 or 3 years or more than that .
they dont know.All sucks.USCIS should go outsourcing.
 
Well, GCLingum, I have to hate your answer. I have only waited for 14 months. Guess I will miss the upcoming boat. Arrrrrrrrrrrrrrgh :eek:

Don't say that. Keep your spirits up. The way USCIS works, you never know you might see approval next month! :)

Trust me, it is not easy to live without GC for 19 years. I was not thinking of staying this long when I landed on July 20, 1988 on F1 visa. I was thinking of going back .. but as every one experienced... it is not easy after living few years in America.

Now, it will be extremely difficult as my eldest daughter is college bound next year. And other two daughters are 14 and 9 years of age.

The strong faith helps me get going.

I pray that all the people who are waiting for their turn of GC approval keep patience. Do whatever in their capacity to move their cases and leave upto God.

Hi All,

Before starting to hope, we all need to start understanding the pulse of USCIS. For instance from mid-Aug '07 to mid-Sept '07 the the definition of a "long" pending NC was "greater than 6 months" & USCIS had some "understanding" with "whom-so-ever agency" and started to finish off with some of our cases by issuing NOID for medical RFE etc.
From mid-Sept '07 the definition of "long" NC wait changed to "2-3 years". This change of definition for me means that I need to wait for 10 more months before pulling some strings. Before which all my shouts will fall upon def years.

USCIS must have seen that a > 6 months filter might have brought out a lot of applications in comparison to a 2-3 years filter.

But the problem is after 10 months the definition might change to >5 years, who knows.

So those of us who have waited for their NC for 24 months, start doing the need full. Rest of us can also start doing the same, who knows what the future holds.

I totally understand the pain of all whose wait time is more than mine.

Friends/co-sufferers please understand the above is just my pure speculation and Iam not an immigration lawyer.

Any comments are most welcome.

I am very sceptical about this new glimpse of hope. If sntr Lofgren manages to make this change and compell the USCIS to do something for long waiters, first it might take a while before they start. And even if they do, how will they tackle it? USCIS does not even have a technical base to pull out certain cases in a sorted order. They don't have any reporting system, that would produce, say, a list of cases with the given age range. I don't think they do.

So they will handle it in a random manner again. We will probably have to send them requests to expedite and they will be handling them randomly. So first they will get overwhelmed with hundereds of thousands of requests in one week and then they will go fishing for our files in the chaos of dust, and good luck with that. I'm sorry but after so many years of waiting I have very little hope for USCIS.
I think it's best that we don't rely on their mercy and use the WoM instead. I am preparing mine. I am certainly not paying the new application fees this coming year. And I think it will take them more than one year to grant us some relief on their own.

Hi!!

I had been active in this forum before, but have been quiet for several months. I have been somewhat discouraged bu the lack of progress on my case. I have written letters by regular mail, email, certified mail, courier to Mr. Hooton at FBI without response. I had inquired through Senator and Congressman, and only reply I got was it is pending and recheck in 6 months. They apparently were not able to ask for expediting the Name Check. I have sent two letter to the First Lady. First was at least 6-9 months ago and never received a response. The second was sent 3 months ago, and I had not heard back. I was getting very frustrated and depressed at the lack of progress. Today, finally I at least got a letter from FBI. The letter acknowledges that my Name check was received in April 2004 and details why it may take long time for the name checks and how a FOIPA showing "No Records" does not mean much as far as name checks are concerned. This time the letter says that the "Name Check is in process".

In some other thread, I remember that there was a difference between then saying "Name Check is pending" versus "Name Check is in process". Does any body know more about it?

Also who are the IO that are being referred to in this thread and how to reach them. My name check has been stuck for 3.5 years now, and I want to do what all I can to get this over.
 
Nothing encouraging to tell you, my friend.
I've gotSAME FBI reply "NC in the process" in April.
Apparently "in the process" means "not complete".
Still there...
