Name check help!!!!!

I just got the information after going to an infopass appointment that my name check is pending while my husbands is cleared...... I am in a state of shock.. i was expecting that my husband to be the one that could be delayed not me... I am a female and never had even speeding ticket.......since I am the primary applicaant, it means that all my family is stuck untill i get cleared :( :( :( :( :(

I heared somewere that once your name check is sent that they reply on 85% of the cases in 72 hours... Does this mean that all the remaining 15% will have to waite in line for 2 or 3 years or some get cleared in months and some longer? please guys share experience.....

One more question... I heared some people filling an INS expedite name check request... I could not find such a from online... can anyone help me get that form??

Yes, it is a very difficult fact you are facing like me. only5% are stuck in name checking, Maybe will take 2 or 3 years as all other people say so.

I was stuck in name checking for 10 months. I am a primary, but my wife & my son got their G/C 6 months ago.

You can only just wait, lady.

I have been stuck in name check for almost 2 years now. I tried through congressman and the senator without any luck. If it had not been for the namecheck, I would have already had my GC approved. Now I am stuck in this retrogression mess. So it really does not matter, and I have now stopped even checking into it. The process of namecheck is totally opaque, and there is no telling when you get through.

Same here. Even my anger to such stupid name-check process has been burned out.
 
so u guys are telling me that all the letters that my employer wrote to the FBI and USCIS to expedite the thing are just a waste of time :( :( and i'm just going to waite untill my category gets retrogressed :( :( :(

Well, my name is completely Arabic........ since I am from and Arabic country...... but my husband's name is Arabic as well....... and he got cleared :confused: :confused: :confused: plus, I am a female Dentist...... and have been living here for the last 5 years legally......... and I have been spending the summer 3 months of every single year of my life in the US..... So I really don't know what could be the reason :( :( :( :( :(

i still would not worry yet. Some people here say that after FP first LUD is FP second is namecheck. How many LUDs you had since FP?

I had my FP on 12/28... I had one LUD on 12/30 and one on 1/4.... but when I call the TSC and when I took and infopass APt. they told me that my name check is still pending... I hope I can not worry... But the Feb visa bulletin is not out yet and I am really worried that I could push me 3 or 4 more years...
 
Name Check - is the 72 hour time line for FBI only ?

I am actually in a very similar situation, my wife and myself had FP/Bio done on 12/13. FBI finalized the FP review in 2 minutes and sent it back the same day. Which seems to make sense given that we got same day LUD on our I-485 application.

However the name check is pending for both of us.

As it is my name is a) german b) rather unique so I don't think that there are many duplicates out there. With regard of my wife - with a Chinese name - she had name checks done before - and did pass.

Which makes me wonder whether this 72 hour time frame that has been mentionned in this forum really applies only to the name check part done by the FBI.

Given that many more agencies are involved it could take longer. (i.e. if you got a visa such as an H1 from an embassy / consulate within the last 12 months - the USCIS need to contact this post and ask them for their input - the USCIS needs to wait for up to 60 days I think for a response from the post)

Unfortunately the FBI doesn't answer any questions on the name check status anymore - so I couldn't check whether we passed that part or not.

In a nutshell - I don't think you need to worry yet.

Well,,,,,, here is my update...

My employer sent a letter to Director Hooton 2 days ago to expedite my name check since I am the only Dentist in the whole company of maybe 12 branches that is a Pediatric Specialist.....I actually am the only one in the city and in 30 miles radius....and it seemed very strong and convincing....

Today the manager of the office I work in called the FBI and they trasferred her to lady called sandra....... this lady checked on my status and called me in 15 mins (pretty quick)........ So she told me that my name check is still pending and it could be a while before it cleares she said "it is in initial processing its too early to check now"......... so I asked, but how come mine and my Husbands were submitted at the same time and he got cleared?... she said this is normal.....

So basically even the fact that I work in the Health field did not help...

I guess I might have to look for alternative plans.... since by the time they clear my name, I will be stuck in retrogression...... so at least 4 more years... which is around the time i am plannig to go back to my country... so to me its pointless at that stage to waite for the GC........I will just accept the fact and go on with my life on the H-1b visa.....

what makes you think you (or we, for that matter)are going to be stuck in retrogression?
 
they said that the department of state has announced that EB-2 world will also retrogress sometime in 2006 :(

I know that this wait is very difficult and rules are getting worse for immigrants on a daily basis. All I would say is that you should keep trying by writing letters to the FBI Name Check department. The FBI name check has turned out to be a nightmare for a lot of people but eventually the names have cleared. It has taken 2-3 years for some people but it does get done eventually. As for retrogression, that is another problem altogether. None of us can say what this year has in store. As of right now the situation looks bleak but things can change. All we have is hope. We should not allow anyone to take that away from us.

correct me if i'm wrong, but you're already not influenced by retrogression since your i485 is filed.... :confused:
 
ya but even if its filled and approved u do not get the GC unless there is a visa (ur priorety date is current).....so if it gets retrogressed to 2001 then 4 more years and then u get the GC even if all ur papers a complete....

so you live on EAD and AP - not a biggie :)
 
Thanks for the thought Michvin... but my case is a little bit more complicated than having the EAD or AP........ any way it does not matter at that point... its all now in Gods hands and he will give me whats best for me.....
 
NNCP stuck with FBI for 3 years!!!!

USCIS filed my name check with FBI since 01/06/2003. I can't believe this that they are taking 3 years and counting to clear my name. I have a very commom Arabi/middle eastern name. I have done things like call, sent letters, faxed letters and nothing has happened yet. I guess i have to play the waiting game. My wife got her GC in 2004 summer, and i am still waiting, just renewed my 4th EAD and AP.
 
why dont u try the court?.... i have seen sucess stories... im just gonna waite untill my date is a week past the published prosessing... and if my category is still current i will file with court...
