name check help

I contacted local congressman regarding my case. According to their info my file is stuck at the name check status for more than 2 years. Does anyone have any info/experience on how to get FBI to look at your file and get the name check done quickly? Please let me know.

nothing really effective except for a law suit. Even a law suit with $2-5K does not guarrenttee a result on your favor.

Senators and congressmen are always shy away from the FBI name check issue. The most they can do is to make inquiries on your behalf, similar to the email queries that you sent to FBI and wait for 6 months for feedback.
 
Thanks for the reply. Are there many more like us? Is there something that can be done if we voice our opinions together?(like a class action lawsuit)

there is basically nothing we can do except preparing for the worst.

try to take up a hobby or work really hard so that you don't have to stay in US to be happy.

lawmakers don't want to interfere with fbi's work for some strange reasons unclear to me.

wildthing is right. I've tried so many things and so far only attorney's are eager to help me (for my $$). They told me that a Writ can increase the chance of getting denied IF there is a base for it. SO they need to review the case first.

My new hobby is home improvement, and I am getting ready to finish my basement! That will keep me busy for up to a year and hopefully by then, my name check is completed! :) :)
 
I was able to get name check cleared with help of Congressional office. OR Congressional rep can send request to USCIS for Name Check expediate request. My name check request was send on 10/3/2003 to FBI and cleared last week after congressional rep request. Make sure you also send FIOPA request, when congressional rep sends a request. They must reply to your FIOPA request within two to three weeks.

which state are you located?

I am in WI and the local congressman's office doesn't want to ask FBI to expedite my name check and want me to wait until my I-485 receipt date (April, 2004) to become current before they ask FBI about my status again.

Also, how much time did your congressman take to get your name check done?

Initially, I gave her all details for FBI Name check with some general FBI contact numbers. When she contacted those numbers, they said they are not set up to deal on a different or more responsive level and also advised not to contact the FBI. However, she did send to the public e-mail address a detailed request. Next day someone from FBI office contacted her and gave her FAX number for congressional inquiry.

FAX Request from Congressional Office was send on 7/28/2005. From my part , Faxed FIOPA request on same day. Received following response on 8/4/05
Dear XXXX:
Ref: LIN-XXXX and LIN-XXXX
We received this news from the FBI Name Check division. I was assured that the fingerprint check is much faster, so this is the big hurdle. Here's their response:

"I am responding to a facsimile submitted by you dated July 28, 2005, concerning the name check status of your constituents, XXX (DOB XXX) and XXXX (DOB XXXX).

A review of the FBI's Name Check Program database revealed that a request from the United States Citizenship and Immigration Services (USCIS) for Mr. XXX was received on October 2, 2003, and completed on August 4, 2005. The result will be forwarded to USCIS, Washington, D.C., during the week of August 8, 2005. Likewise, Mrs.XXXX request from USCIS was submitted on October 2, 2003, and completed on October 3, 2003. The result of her request was forwarded to USCIS, Washington, D.C., in October 2003."

Now all you have to do is wait for the new visas to become available! I hope all goes well. Please keep us in the loop.

Finally, on 8/5/05 received "No Records" response from FBI for my FIOPA request by mail.

Hope this helps. You need to find right person (willing to help) in senator or congressional office.
 
Last time when I checked with USCIS, they said that I am stuck in Name Check. Recently I got RFE on 485 does that mean that My Name Check is cleared???
