Name Check for I-751 and N-400

Hi ya all,

I just found out that my name check for I-751 (removal of condition) has been pending for one year. I applied for Naturalization (N-400) three months ago, and of course another Name check request has been sent out by USCIS to FBI.

So the questions I have been wondering about is:

1. If my Name check for I-751 clears up, will that be sufficient for N-400 as well? Or will USCIS keep waiting for Name check request for N-400 to clear up as well?

If I-751 Name check clearance is usable by N-400 application as well, then:

2. What is the best way to speed up the Name Check clearance for I-751? Should I request my congressman/hire a Lawyer to push for I-751 Name check request to clear up (as it is already late by 1 year)?

No one really knows what they will do with your Name Check... logically thinking if one passes, they should pass the second one too, but they don't do anything logical.

Speeding up the namecheck... hmm... there is one way and that WOM... but for that you have to wait some more time... writing to your congressman or other people might help... some people have been sucessful to do so.
 
Who told you that? USCIS official? As far as I know, there is no back ground check for I-751, unless this is a very recent development.

I am neither a lawyer nor do I know much. I just happen to know a little about US and Canadian immigration law and that information is derived from personal experience and a little reading.

Triple citizen... are you a lawyer? You seem to know lot about immigration in detail...

Yeah, USCIS and my Congressman told me about name check for I-751. Personally, I think it is a foolish idea, because for all practical purposes, I have already gone through Name check for green card, and doing it twice does not match with the intention of 751 (establishment of legitimate marriage). However, this kind of not well thought out policy is expected from USCIS any ways.

If I can, I plan to use this opportunity (Name Check request for I-751) to push for my N-400 application. It is tricky, but I am sure it will make perfect sense if I take it to court. I hope that I will find some one bright enough that it may get sorted out with out court involvement.
 
Though I am afraid that USCIS may let go of Name check request in response to recent court decisions.

I know an N-400 forces the adjudication of a stalled/pending I-751, but this name check requirement for I-751 is a first for me. Good luck!!!
