Name Check Cleared

Received a letter from the senator’s office stating that USCIS has confirmed that my FBI security check has been completed in October 2005. Now they are waiting for EB3 to become current at that time another finger printing will be required before they could adjudicate my case. So drama goes on…I have completed one finger printing in 2004 and biometrics in June 2005.

I don’t know how my name check was cleared (pending since March, 2004). I sent several letters to FBI and also explained the situation to a congressman (who refused to contact FBI citing stupid reasons).

I am not sure if my name check was cleared due to contacting this senator, or FBI showed some compassion, or due to my letters to FBI or may be they are truly working on backlog cases.

I lost my chance of getting GC long back due to this name check issue. Now I am stuck in EB3 retrogression. I am trying to use cross chargeability (my wife is a citizen of non-retrogress country), but rest of the world is also stuck at April 22, 2001. I hope it will move forward is coming months. I have lost hope of getting it under EB3 - India.

ramfan, i'm on the same boat....I'm also eb3 india case...PD: Sept '02. Even my wife was born in non-retro country. both ways PD sucks for us.......

Ramfan, How do i know if my name check being cleared or not? I had boimetrics on Aug 2005. But there is no update to my I-485 application with PD: 2003 and retrogressed country.

it's still unclear why we need to do a name check again that only causes delay in our application...

Does anyone know if our namecheck procedure + ( Fingerprints/ biometrics) is different from the visa namecheck at the NVC?
