Name Check and the Nature of one's job

guys,

I was working for a national lab, most of my friend there stuck in Name check. I myself has been stuck since 08/2004.

I got a feeling that the time for name check is related to one's job. I would like to do a survey here. can you please let us know how long it took for your name check or how long you have been waiting , and the nature of your work when you file I-485?

Myself: Engineer in a national lab, has been waiting for 22 months.

Research associate in University, not even close to any security issues.

I am just waiting for 60 days, no reason to panic yet, but now I am worried about the fact that I have went through security clearance to attend meetings at NASA and at a couple of Air Force and Navy labs... (I was in astrophysics before jumping into software career). There ought to be some record about that, and if it is in a paper form in some odd office - I am major league screwed. :(

Also - I know a bunch of graduates of Moscow Physical Technical Institute (thankfully, I am not) - ALL of them are stuck in namecheck for several years applying for citizenship. hard to believe that it is a coincidence...

I know few people stuck in NC who worked in "pochtovyj yaschik" long time ago (even for short time only), they thought they were stuck because of that... however, I myself did not work like that... graduated from "normal" University (Moscow Lomonosov)... no relation to military whatsoever... never any criminal issues in my life... still, got stuck! And not because of my country, I know a lot of people from my country, with common names, not stuck...

I have some questions for you. How many times and when did you do EAD and FP, as well as medical examination? Did you send employer letter when you filed I485? When your I485 was approved, were you asked to provide a new employer letter or paycheck stabs? Any reason for your long time name check? Did you require expedition?

After my I140(NIW) approval, I filed I485. Now have been waiting for 1.5 years because of stuck name check. I sent employer letter together with I485 application. Later I changed employer, but still in a similar field. Now the position is not stable. I will change again, maybe to a different field, or maybe no position. It is not good for NIW case if a new employer letter will be required in the future.

Would you please give me some suggestions? Thanks!

only one EAD, at local Baltimore office, applied Aug 2005, got Nov 2005 (my daughter and spouse had 3 or 4 EADs)

two FP, 1st in Oct 2004, 2nd in Feb 2006

one medical filed together with I-485

You should make all effort to have active position at the time of interview (if you get one) in same field; try not to change your mailing address...

For your interview, were you ASKED to give a new letter / paystubs(how many months?) or you VOLUNTEERED?

Do you think your interview was because of your address change? Will address change surely lead to an interview (even if the case is NOT transferred to a local office)? Can the interview be postponed for some reason? What were asked in the interview? (Normally interview is needed only for family-based. Why did you NIW have one?)

yes, they asked for employment letter and paystubs, also asked for paystubs for spouse. It was 3 last paystubs, I was paid bi-weekly so it was for 6 weeks. I do not remember if they asked for tax, think yes, they asked for last years taxes filed after submission I-485.

I did NOT change address after filing I-485: I filed I-140 from CA, then moved to MD, then I-140 got approved, then filed I-485 from MD. Moved to TX in Dec 2005 but did not change address, family still there, so I just had to come to MD for FPs in Feb 2006.

I do not know the reason for interview, learned from this website that at that time (2003-2004) a lot of NIW cases were transferred to local offices, which normally means you will have interview.

Do NOT postpone interview, for details and questions on interview please go to thread dealing with your local office, a lot of this info is there and how to reply and what docs to bring with you.

You wrote that you requested for expedition thru Congressman because your daughter was aging out. Can you elaborate on that issue, please? Couldn’t you use the Child Status Protection Act? The issue is most important to me. That is, my EB1-OR was approved on 5/18/2006, with a PD of 11/04/2005; I have a son who will turn 21 on 6/22/2007.

How did you know your case was transferred to a local office? You got a notice from VSC? When do you think the cases normally are transferred? 1 -1.5 years after I485 filing?
You said "have active position at the time of interview (if you get one) in same field". If there is a carreer gap before the interview, is it OK? Will the interview officer ask? Is it critical for NIW?

Yes I think my daughter was covered by this act.
But - this was only one issue to ask for expedition... and I pointed this out to the congressman... and later all family got approved.
You can simply write to congressman and ask same, and see what will happen, and of course not to rely for this...

When my case was transferred, I first learned about this from the website online status, then received notice by mail. At that time cases (as I think) were transferred close to the processing time, I filed I-485 at same time as my colleague, and after 15 months my case was transferred, and her was approved. recently I saw many cases transferred to local offices very soon after filing.
I do not think they care about gaps on the interview. They want employment letter and paystubs (3 recent) and taxes, you just give this and that is it. If you do not have paystub, it still may be fine, someone got interview (also NIW) having just an offer letter, job was supposed to start like a week later that interview...and all went well. What I think, they just make sure you work, or will soon work, within the I-140 area.

I feel much relieved to confirm that my son is covered by CSPA. If I understand the law correctly, his age is locked in on the date on which an immigration visa becomes available in my immigrant petition, EB1-OR approval day in my case (minus the number of days the petition is pending). Therefore, his age is locked at 19 year and four months, and if applies for adjustment of status within a year of the I-140 approval date, he will get green card no matter how long the process takes. Right?

Anyway, I might use your tactics. I will definitely write to the Congressmen that we need their support in expediting our case since my son could be aged out. Please share with us any other tips to expedite the process if you can recall. Thank you very much again, compass!
