Name change

Hi ,

My wifes last name needs to be changed. We didnt take care off it before applying for 485, EAD. Our ND for 485 is 4/03/2003.
We both have EAD/AP.

I am going to get her name changed in her passport.

1. How would this effect her existing EAD/AP ?

2. When can we inform BCIS of the name change ?

3. When we apply for EAD/AP renewal how do we go about the name change ?

If I am in your situation I will not try to change the name or last name of spouse on passport because you and your wife EAD, AP, I-485 filed.

With clear cases BCIS mess up and commit mistakes and you are going to create problems for your self. Better not to change any name or last name at this time it may create problems for you and delay in processing because again you may have to send new name change documents to BCIS and they may not attach it with pending file. Many change address and inform BCIS but BCIS still sends the documents to past address. Don’t confuse BCIS let it remain as it is.
Please speak to your lawyer before making any changes and how this can complicate the BCIS
