Name Change on Cert

Hello everyone,

USCIS changed my name on cert to match my birth cert. I went to social security office to update the record and name change. The SS staff told me that my record was not updated by USCIS and they have to get clarification/confirmation that I am a US citizen and that I should expect to recv my SS card in 2 months time as it takes time for USCIS to respond to the request. I changed my name on my DL which was not a problem.

I applied for passport on the 24th, sent my original cert, my ID showing my previous name and a receipt showing that I have applied for new ID with corrected (new) last name.

My question to you all is that there is no mention of my last (last name) on my cert, neither was I provided any proof by USCIS that they changed my name i.e. any letter stating that name was changed or anything. Will there be any delay in my passport. I applied as expedite service and over night delivery and all the bells and whistles

USCIS will go by what your birth certificate says. Adding a last name that's not on your birth certificate would be considered a name change. If you didn't request a name change at interview, then your certificate will show what your birth certificate shows.

What receipt are you referring to? Who issued you this?

Expect a delay in processing since there is a discrepancy between certificate and the name you are requesting to appear in passport.

Ok here is the scenario:

My name before citizenship was ABC , AO stated that I cant keep my last name ABC because that's not on my B/c, so I can request a name change that my take a while to process or I can take oath today with last name on b/c. I decided to take the oath the same day so my last name now is XYZ.

I applied for passport using last name XYZ, but the name on the ID that i attached with app shows ABC. Although I requested a name change on my state ID, They (DMV) gave me a receipt showing my new last name XYZ.

My question was when a name change like this happens is there any letter issued stating that name of applicant changed at the time of interview to match the B/C or endorsment on Citizenship cert?

According to what?You just decided to go by last name of ABC eventhough B/C shows XYZ? Or did you ever have a legal name change to ABC?

Again, how did you previously change your name to ABC? You just used ABC as name without legally changing it?
 
So USCIS will have a copy my birth certificate? I am guessing that they have it on record from the I-485 application. Right?

Yes. there was no legal name change, and AO during my GC process didnt catch this mistake. Thats what the AO told me on my Citizenship interview, They had my B/C from GC process as well. Actually there was no name change it is merely the order/sequence in which i used my name is different than what I have on my B/C.

If there is a name change during interview process, do USCIS provide letter with certificate or endorse the cert that states there was actually a name change? Someone told me that they usually provide something called a name change letter with cert. Can someone confirm this if your name was changed during interview process.

Yes, there have been reports that you get a name change letter when you request name change as part of process. But since you never requested name change at interview the point is moot.
 
I did request a name change at the interview (to drop a middle name). At the naturalization ceremony they gave me a N.C. with the new name and a letter, with a court's seal, stating that my legal name was changed, and how.

In the OP's case the IO decided that the legal name was XYZ to begin with and that ABC was just a name that the OP used incorrectly. In such cases USCIS does not give any letters regarding the name change since, technically, no name change has occurred.

I heard that the State Department does allow and can still approve a passport application in case of small differences in how the name is written in various supporting documents. But if the difference is substantial they might deny the application or request additional documents. In the OP's place I would probably try to first change the name on the driver's license before submitting a passport application.
 
I already sent the application for passport, hope things go fine. Thanks for the input Baikal3. You are right, tehnically there was no name change, rather a correction. I should have included my B/C with the application. I checked the status it's still in process so see what it says.
