My I140 is approved in TSC on Jan \'25th,but NVC did not still receive it..what should I do?It\'s 90 days & so i called nvc ,they told they will send a letter saying that they did not receive to us & we should find out the reason with TSC.Do anyone have sugggestions for me?What to do...
 
thats how it works ..NVC will send a cable to TSC

and then TSC should get back to them (probably with the file !!) ... try calling TSC and explain them the pain that u are going through ... speak as if u are speaking from the company\'s lawyer\'s office (u will get a better response) ....

If nothing works try going the AC-140 route ... hopefully ur consulate is not chennai???

AC-140 is Attorney Certified 140 where you send all the necessary paperwork (AC copies) to the consulate and they process u on based on that. Unfortunatly, Chennai does not accept such filings and wait for the NVC to do the needful.
 
sure you can go for AOS anytime provided the PDs are current and they are now :)

but remember TSC is way behind others in AOS ...it may take upto 2 yrs at the current pace at TSC ... so for TSC guys CP is the faster way ...had you been under another service center I would have definitely recommended AOS ...

Now if u live under the jurisdiction of another service center, especially VSC, but ur 140 was approved from TSC, then file ur 485 with the service center that governs ur residence. (and NOT TSC)

Actually my PD is FEB\'99 & i applied for my 7th yearvisa ext in TSC in March& still waiting.I work for a client in NJ but my company is based in Atlanta.So Is it better for me to wait till NVC receives my case or just go for AOS.And can i apply AOS in VSC.

Chennai going against the state dept memo on AC140

If a consulate is approached by the person want to do AC140 then if they cannot accept based on the work load (that is what Chennai gives the reason) theny it should notify the DOS. DOS will then assign the case to another consualte. Chennai seems not informing the DOS of their inability to accept the case.

I would suggest if any one have intention OR interest to do the AC140 at Chennai then should make a forum and take up the case with DOS.

KrishnaP is doing that him self (he doesn\'t have support from others) I am sure he will succeed in his efforts if every one comes together then you will open doors for others. If any one has interest then look for the meesages he posted in this web site and contact him.

This is the time to give a thought about this by Chennai Consulate guys.

I got letter from NVC THAT they did not receive from INS & we have to refile.
NVC DID not cable to INS .it sent a letter to me.Did anyone have any this experience
 
That\'s what it does.

It just issue a letter saying that they do not have your file and advise you to re-file. There are number of persons experienced that. You might want to search before waiting for some one to answer. That would save your time. I don\'t think re-filing would solve your problem, same problem might happen again. One thing you have to do is pressure your attorney to do some thing about that. otherwise AC140 OR AOS. Look for \'rajum\' experience.
