N470 Renewal

ART2010

I'm a valid LPR since 2005. I had to leave the country due to a job transfer from my US based company to their UK subsidiary in 2009. I had applied and received my N470 for 2 years - expiring Jan 2011. Questions:

A) Can I extend this for a further 2 years?

b) What kind of requirements?

Yes, you can get another for 2 more years. But by using up those 2 extra years you'll probably violate the physical presence requirement.

Why are you asking about the requirements, given that you already got one successfully? Did you change employers, or was the first application handled by lawyers without you understanding what was done?

My job assignment in the UK may extend for another year and half and I needed to keep my cover to naturalization open. Even if physical requirement is passed, I would envision myself coming back and then getting the required physical presence before filing the N400 - Proving at all times my intent to eventually return and continuous residence cover. Is there any other alternative? I didn't think that only the I-131 would provide that cover and the needed evidence.

You'll need both the Reentry Permit and N-470 ... RP to prevent your green card from being cancelled, N-470 to preserve your continuous residence for naturalization eligibility.
