N400 - Unemployed during Green card

Dear Friends,

I am planning to apply for citizenship since completed 6 yrs in Green card.
Please post your comments for the below questions:

This is the situation:

After I-485 applied I was laid off due to cost reduction and able to find similar job in the different employer. I got the RFE before 485 approvals and updated to INS regarding the new employer in July, 2002 and then 485 approved in July 2002.

Again, I was laid off in April, 2003. After that I forced to develop new skills to find new job which took couple of years since there is no job opportunity in the same filed. During those two years worked as consultant for three months. Again could find some temporary work for couple of months with new skill set.

But, Now I am in full time position for the past three years but the job description is different from the green card job description.

When I fill the citizenship application in the employment history for the past five years ( say from August 2003 to August 2008). I was unemployed from April 2003 to March 2004. I have employement for three years only in the last five years.

Questions are:

* Will it be an issue since unemployed (due to lay off) and also currently in different job description ?

* Also, Tranffic violation ( couple of speeding and minor accident) should be mentioned in the Question 16 in N400 application(citation and penalty paid for plea guilty) ?

I appreciate your comments.

No.

If it's a traffic citation that doesn't involve drugs and the fine was under $500, then no.

Thanks The real Canadian,

Sothat means, Just show the employement history of last five years though from 2003-2004 nothing to show ?

Yes, My traffic violation is below $150. No drug involved. Just speeding.

I think you should be OK since you did work for 9 months after GC. During the period that you were unemployed simply say self employed as consultant and mention your home address as business address. In the interview simply explain truthfully what happened. Having a job at all time is not a requirement but working for some time for the sponsor is generally a good idea.

Others would disagree. Supporting documentation for a minor traffic violation is not required according to the instructions, but it is quite debatable whether the incident should be mentioned or not. Each individual should make their own decision themselves on whether to disclose it on their own N-400, without blanket declarations advising others that it does not have to be mentioned.

I just filed for N-400 and based on the discussions on this forum I agree with Jackolantern. I specified my ticket info (had 3) on n-400 and also attached a sheet with extra information (like they are minor like -speeding and the amout showing <500 etc). I didn't attach any proof like receipts etc.(I do have them though).

Goodluck
