N400 Denial due to 90 day restriction residency status

Hi,

I posted 2 weeks ago about thinking to reschedule my interview as I had to leave suddenly due to a funeral. I didn't reschedule and went ahead for the interview. Everything went well till up to the point that she checked my residency status. I moved from West Coast to DC in October and applied for citizenship in November. Apparently I need to be a resident for 90 days before applying. I wasn't aware of this.

So, now I have to resubmit my N400 and pay another filing fee. Big question is, my driver's license was issued in February 2012. If I apply now, could I use my lease documentation as a proof that I was a resident since November?

Yes, that should be fine. Also, on your N400 form, you will be listing your current address since November.

Besides, did you also do your change of address AR-11 with USCIS to your current address?

Thanks. Good to know I can update my address. I am bummed that I was denied, not to mention lose the $680. And, I have to start all over again, another 5 months of waiting.

The rule is mentioned in the N-400 instructions and also on the checklist; however, it can be missed easily. I have seen many applicants who were in the same situation as you, so do not feel bad.

Hi cookiebeast i'm sorry to hear that , I've had the exact same situation at exact same DO Fairfax VA right ? that is the same DO you went for your interview right? I was denied last July and i replied in September of 2011 and had my interview in march of this year now waiting for a decision . As for as proofing your residency your lease will be good proof and also try to get Va license because they may give you hard time about that so play save and take care of that . Good luck.

I reside in DC but I went to DO Fairfax for interview. My driver's license was obtained in 2/11/2012. I guess I could wait extra few days till 5/11/2012 to submit my application, to play it safe.
