Hello

Seniors on GC who have stayed for more than 30 months after getting GC in November 2011. There are 2 instances where they stayed outside the US for more than 6 months ( but less than 1 year). They have no income/house in the US and stay with their child (US citizen). What document can they present to show their continuous residence. All their kids are US citizens living in the US

Any pointers would be much appreciated

thanks

I would say evidence that all their kids (and grandkids if any) do in fact live in the US as US citizens would help a lot--if there are more family members in the US than just the one they live with and/or who sponsored their GC get that evidence. Show that the entire family clearly lives in the US and there was no way that the parents could ever have intended to move back to the original country permanently with the whole family now here in the US.

Also USCIS will probably ask why they did leave for over 6 mos a couple of times--so it will help to have a clear story ready. The ideal answer--although I don't know if this is true in their case or not--would be that these were one (or two :) ) time trips to wind up their affairs in their home country but unlikely to be repeated.

Also they should bring whatever documents they do have in the US. Can they show that they have a driver's license or state ID from a US state that they've had continuously since getting the GC? Basically just bring as much evidence as you can to support the idea that their stay in the US is permanent and their trips back to the home country were temporary.
