N400. 90 days before. How soon everyone is applying ??

I got my GC on Nov 10 2004. Planning to apply ( mail it with 2 day shipping) on 14th Aug this year. Is that OK or too soon ??. Thats right on the 90 day mark. Technically I know I can, but they cant approve until Nov Nov 10 this year which falls under 3 months processing time. I'm not in such a hurry to get citizenship but certain events in Dec/Jan are forcing me to apply as early as possible.

Any opinion on what is the trend in TX center for NJ filers ??

Should it be OK. You should check those timeline thread for your DO
and estimate when you can get your interview date. If your DO processing time is very short, you may have an interview date before your 5 years of
GC is up, that may not be a problem but it may cause rescheduling
(rescheduling is very painful experiences)

Give it a week after 90 days to be on safe side (i.e., around 85 days before 5 years completion date)

Applied 89 days before 5 years of GC complete

I and the spouse applied today, exactly 89 days (counting both days on either side) before the 5th anniversary of the green card. Talk about tight margins of safety. Hope all goes well.

I usually recommend counting 85 days. Unless you are in an awful hurry USCIS processes cases very quickly and you might even have your interview or oath delayed because it falls before your 5 year anniversary.

Huracan is correct. Usually it is very difficult how to compute 90 days, whether to include approval day or not, whether to include applying date or not. That is the reason all old memebrs in the forum sggests go far a safe 85 days margin. As that will not give USCIS any scope of rejecting application with reason "APPLIED TOO SOON". I also followed that advise and applied with that criteria in mind recently.

Well it is done now. I will keep folks posted on if there is an issue. I think I should be okay, though I doubt if the USCIS will let me argue math with them. Here is the exact info on my application in case someone has any comment:

- Permanent resident since: 12/21/2004
- Date N-400 postmarked: 09/24/2009

Sep: 7 days (including the 24th)
Oct: 31 days
Nov: 30 days
Dec: 21 days (including the 21st)
=>Total = 89

Let us see how it goes.

I think you should be OK. I hope you have signed and dated for 9/24 as well? The only issue could be if the oath date is scheduled before the 5 year anniversary. Trying to gain a few days here could potentially delay the oath (sometimes considerably) if you have to postpone it.

First of all congratulations on your citizenship, that is an amazingly quick timeline.

Yes, I dated the application 09/24 too, including the cheques. I hear your point about the whole process happening within these 90 days, which would mean the oath would need to be rescheduled which I understand is a major pain.

When I received my green card in Q4-2004, there was a huge backlog of pending 485s. Then someone at the INS decided to brew some coffee. It appeared like they had opened the sluice gates. Suddenly a large number of people got approvals. I was fortunate to be swept by that wave. I suspect that wave will hit the INS now in the form of a large number of N-400s around this time. I reasoned 90 days from start to finish may be a bit aggressive, and it may be better to get in the queue as early as possible. Of course, I am only speculating from the outside, I have no access to any data to support this hypothesis.

Law says 90 days before 5 yr. anniversary. To be on the safe side, make it 85 days before 5 yr. anniversary and then mail it. It won't hurt to wait for 5 extra days because this is the last and final step in immigration process. Otherwise they will cash the check, call you for interview and then tell you to file again because you filed a day early.

Actually, can you show me where does it say 90 days before 5-year anniversary?

Clarify the 90 day rule..

90 day rule is
the date the application Mailed/Signed ?
or date the application received ?
or PD ?

Thanks

Up to 90 days before the application is received and receipted by USCIS. Don't go by calculating exactly 90 days..it's recommend to use a few days less in calculation to avoid any surprises.
