N-470 Pl help

My company has sent me on a 2 yr posting to europe. they are willing to file an n470. howver this company has its world headquarters in europe and they have a us subsidiary of which i am an employee. My big question is do i qualify for n 470 becuase this is a european company



pl help with your inputs. thanks

American parent company

I don't think you will be qualified as the parent compan has to be American firm.

According to N470 instruction, your absence from US has to be "...For the purpose of engaging in the development offoreign trade and commerce of the United States onbehalf of an American firm or corporation or asubsidiary thereof".

Also the requirement on supporting document stated that "...If it is a subsidiary (whether American or foreign) of an American firm or corporation engaged in thedevelopment of foreign trade and commerce of theUnited States, the affidavit should be:-- Executed by an appropriate administrative official of the parent organization, and-- Should state the facts of ownership and/or control of the subsidiary, and-- Should state the exact percentage of stock owned by the parent organization.

A lot of european companies...when they start a company in the US...they usually incorporate a company with similar name which is traded independently on wall street...and the parent european company is just a holding company that holds most of the shares.....

In that case the company you are working for is a US company...check with your company legal department.

For example...if a person was working for T-Mobile USA...then he/she is working for an american company...but the parent company is Deutsche Telekom which is a German company....
