N-400 Marital Question--Domestic Partnership in CA ---PLEASE READ CAREFULLY---

Hey folks, I know this topic gets people agitated and throw comments that we all know : "Gay Partners do not have same rights under FEDERAL LAW" I know this and please do not repeat this ok!!!!

I am in a Registered Domestic Partnership under CA law and applying under the 5 year PR rule.

Question is: How do I disclose my Marital status in the N-400? Single? Other: Registered Domestic partner under CA LAW?

Again, I am not trying to get benefits trough my partner neither he is, so please do not start posting about DOMA and how it is not recognized. We all know that.

Only thing is how to Faithfully answer to this question in order to disclose a more accurate Marital status?

I have been thinking of marking SINGLE (But it doesn't really reflect my real situation and Federal gov does not recognize same sex couples)

And Also as "Other" and explain the DP in CA.


Will it be okay to Mark Single and just tell the IO at interview about my Registered Domestic Partnership?

Yeah, it is tricky because of backward, bigoted federal laws.

You can choose whichever you wish, really, because you will have to explain your situation during the interview anyway. Single seems best at this point, and then it can be changed if necessary at the interview.

Good luck, and let's hope that the feds soon recognise same-sex relationships.

Thanks for your wishes, I also wish they do change the laws, I am lucky that both my partner and I are documented but, it must be terrible to have to be separated or deported from the one you love just because some discriminating law. :(

I had my N400 all ready but then suddenly I was like oh oh, what to write in the marital status? It really is hard in fact and tricky. But as you suggested I will Mark the "Single" and just tell the IO upfront when she/he comes to that question and disclose my situation, and that I will let them decide what is best for federal applications. That way I am not really hiding anything.

Well, I will let you all know how it went, it might be useful in for future applicants to know what they consider for same sex relationships during n400 applications regarding marital status.

That is a tricky question - because you're in a "registered" relationship. If it wasn't "registered" it would be a no-brainer.

I'm in an opposite sex live-together relationship so I believe I marked "divorced" - I was married, divorced 7 years ago. The state I live in, does not recognize common-law relationships so technically I'm single/divorced, despite my living arrangements.

In the bigger picture, if you're applying under the 5-year rule it shouldn't matter either way. In your situation I'd be inclined to check "other" and state the facts, and reaffirm them in the interview. Because you're in a registered domestic partnership (as opposed to unregistered), to me that is a more accurate representation of your situation.
