i went to the citizenship interview yesterday and they said they might deny my case due to my marriage and my son born with different person during that period, the officer said he will proceed to the investigation due to marriage fraud.. I am a green card holder my application is based on a 5 years green card.I passed the tests, but the interviewer was mean from the beginning. So at the end he gave me the N-652 with "Decision cannot be made". he didn't request any documents. I forgot to mention I'm divorcing. My ex husband has an unconditional green card.i applied for citizenship for myself only, what should i do?

How did you get your green card? Your ex-husband filed a marriage-based petition for you? Or were you a derivative beneficiary on your ex-husband's employment- or family-based petition? How long did that marriage last (the marriage that resulted in your green card)?

I forgot to mention I'm divorcing. My ex husband has an unconditional green card.
So you already divorced your first husband, and you married somebody else and now you're divorcing the new husband?

ocinta please explain the situation.

How did you get your greencard? Was your husband a USC or was it employment based or family based?
which exhusband has a unconditional greencard?
How did the IO know you had a baby with someone else? the n-400 only mention name of child, I guess the child has the last name of the father?

Sorry to get personal, but was the child conceived when you were married to husband #1? Are you still married to that husband? How long were you married to the husband who petition you for gc?

I heard from an attorney he knows cases where the io said infidelity is grounds to deny USC because of moral turpitude.
But I do not know. Infidelity or bearing a child outside marriage is not a crime.

I obtained my green card under the Cuban adjustment act. I came to the us after my family won a visa lottery. I have only been married once. We dated for a year married for 2 years. We separated a year ago. We are now divorcing. We are still legally married our divorce is not finish yet.I'm cutrently with the father of my child. My husband obtained his unconditional green card through marriage.

Through marriage to you?

Ocinta, I am not a lawyer and I am sure there are people here way more knowledgeable about immigration than me. That said:

- You only were married 2 years.
- You were separated for 1 year
- You then went and had a baby with someone else.

It might look like maybe the marriage was only for the immigration papers, because they look at the length of the marriage, however if you have proof that your marriage was not a scam, I suggest you start putting it all together, like leases, pictures, emails, joint accounts, etc. I mean my case is similar as I was a dependent from a EB petition, but you know when a relationship is for real you do accumulate a lot of evidence, like receipt, pictures of trips you made together, affidavits of people that knew you.

Let see what the people here says, they are extremely knowledgeable and willing to help.

Iosonamore is right. The IO is probably thinking of marriage fraud. The sequence of events is not helping you. Not only start collecting evidence for your case, if I were you, I will consult with a good immigration lawyer (i.e. our host in this forum).
Best of luck and keep the forum posted.
