N 400 90 Days Waiver

Greetings All,

Thank you for being of great help.

Does INS treat the applications sent 90 days in advace (before completion of 5 years on green card) differently than the applications sent after the completion of 5 years.

Please advise.

if both applications are qualified with other requirements, they will not be treated differently.
 
Dear OCWorker,

Thank you very much for your response. In these 5 years I wa out of US for a total of 44 days, does that matter or do I have to take it into account while calculating the 90 days period?

for 44 days only, you are fine. you can just count it as 5 yrs - 90 days. if you worry about miscounting days, you could file it as 5 yrs - 60 days if you wish.
