N- 14 After passing the Interview

A reentry permit does not preserve continuous residence for naturalization purposes, therefore you do not have 5yrs continuous residence. Without explicitly claiming benefit of the 4yr+1day rule, I suspect USCIS are getting set to deny your case.

As per the Naturlization guide - If you return within 2 years, some of your
time out of the country does count. In
fact, the last 364 days of your time out of
the country (1 year minus 1 day) counts
toward meeting your continuous residence
requirement.

That means if someone has got reentry permit and time he spent in o ther country i.e. last 364 days will be counted as if he is in USA. Right?

As per this, if some one applies based on 4 + 1 rule, will he be considered meeting his continuous residency requirement?

Just wanted to know this rule.

Must admit to being a little confused about what exactly is being asked in the last post.

Any time you break continuous residence, irrespective of whether you have a reentry permit - which in itself only preserves your LPR status - you can benefit from the 4yr+1day rule to accelerate your newly reset continuous residence period which would otherwise be 5yrs from the date of your return to the US.

Some will argue that 4yr+1day only applies to continuous residence breaks lasting from 12-24 months, however USCIS' own policy, as backed up by a memo in the Adjudicators Handbook, says it applies to breaks shorter than 12 months as well.

I got my greencard in 2001 filled for citizenship based on 4 yr law in march 08 and had my interview on 15th july 08 which I passed and received N-652

Just wondering which options did the IO check on your N-652.

Did the IO check Congratulations! Your application has been recommended for approval! or A decision cannot yet be made on your application?

For me apparently, my IO checked Congratulations! Your application has been recommended for approval! still my lawyer told me there is an issue with my residency, I have no idea what in the world is going on with my application at the moment.

On my N-652, they have checked the box of A decision has yet to be taken and will be informed by mail.

The officer told me that once you submit all the documents mentioned in N-14 form then he will review and send a written decision. I am just worried about the time-line.

Would it be 1-3 months?
