My wife's EAD/AP

I posted this message before, since I didn't get any replies I am not sure if I did it right.

Anyway,

Background:
My wife and I are on EAD waiting for GC approval (receipt date last December). She is not working and I just got my EAD renewed which expires end of next month in lieu of getting GC.
We applied for AP and got the receipt notice couple of weeks back.

Question: Can my wife travel on AP without EAD or should I renew her's too.

Also, what is the time frame between receipt notice and receiving approval notice of AP.

--- Depends on different services centers, if you have got the receipt you will get AP in a month time, it is always better to apply for AP or EAD 4 months advance before expiry date

your wife shold enter US before AP expiry date and she shold keep reciept of I-485 filling with her

I applied for EAD renewal/AP processing in the second week of Oct as my EAD will expire end of Jan next year. I got my EAD in 2-3 weeks, got our AP receipt notice end of Nov (guess, they stopped processing AP for sometime I am not sure).

I will give it another 2 weeks which will be a month from receipt date like you said.

Ginnu - I am not questioning what you said but this is what I saw in immihelp.com

"Similarly, getting an AP and using an AP are two entirely different things. Using an AP means going out of US and showing AP to enter the US as a parolee instead of showing the visa to enter the US as a non-immigrant. As parolee can't work in US, he/she should get EAD before traveling on AP. Receiving AP is just addition of one more document in your file."

Does that still mean you don't need EAD to travel on AP.

Ginnu - Did you travel in a similar situation ?
If not, can somebody who traveled in a similar situation please reply to my mail.

*** The Above Information posted on Immihelp.com is wrong, they have many mistakes on that website and fee for many forms is not updated

EAD is ONLY for work, INS Inspector is going to see AP not EAD when you enter and you can check EAD it is clearly written on EAD
"NOT VALID FOR REENTRY TO US"

Thanks so much. That is very assuring.

You are right about fees being wrong. When I was looking for AP Fees, one page said 110 and the other said 130. Naturally I sent the higher one, one more is better and two I thought it was revised.

INS rejected my AP application saying check for 110 was not enclosed, so I resent the app form with check for 110 and that's when I got the AP receipt notice.

I know that things get missed out but if things like this can be double checked before posting or even after and fix it, it would be great especially when lot of people are counting on the web site for information.

I am not connected with www.immihelp.com, you should post to them what is posted wrong on the site, I wrote to them to correct the requirement for filing I-485, they posted that still one needs IRS form, but that is no longer required and then they corrected it, better you should write to them that Fee is wrong or what ever info you find is not updated, one should check with his own lawyer before sending documents to INS
 
I wasn't directing that to you, I just made a general statement so other people would know.

I checked and looks like they corrected it. I did this on my own, didn't want to go through a lawyer, thought would save some money for the winter.

I am planning to file EAD and AP renewals by my self.

Please check following list and update me if I miss any document.

Documents for EAD
1. 2 passport photos. Write A# and name on the back
2. Form 765
3. Copy of 485 receipt.
4. Copy of last EAD receipt
5. Both sides copy of last EAD card
6. Self Check/Money order/cashier's check $120.
7. Signature card

Documents for AP

1. 2 passport photos. Write A# and name on the back
2. I-131 Form
3. Copy of 485 receipt.
4. Copy of last AP receipt
5. Copy of current AP
6. Copy of I-94(both sides)

I have the following questions.

1. How to get signature card? Can I download from somewhere or should I go to INS office to get one?
2. How did you send the applications? Did you send EAD and AP in different covers? What is the best service (FedEx, USP, US postal)?
3. Did you add any cover letters?
4. How did you order the application?

I will greatly appreciate your comments
 
A_V1, Correction!

Should be immigration (Green Card) Photos, not passport photos. They are different. Photos for EAD and AP are also called side photos without earings and glasses.
 
Your Documents are correct, just add TOP part of pervious EAD with EAD application form and write A# ( you can find it on your I-485 reciept or previous EAD)

How to get signature card? Can I download from somewhere or should I go to INS office to get one?
-- You do not need signature card this requirement no loner exist, now INS will scan your signature from EAD or AP form

---Send by FedEx, you can track your packet; it will be better to send in same letter

--Just write, please find application Forms and fees for AP and EAD

--Go to INS site or Murthy.com and download the forms and fill up the forms
You should mail 2 Different INS fee checks and attach to respective application forms

---- Read the EAD and AP application form and provide you’re A # in the column where asked on the Forms

--- Even if you don’t write it will be ok, if you write it will not hurt, expect the delays in getting AP and EAD because of vacations, always better to apply 4 months advance for AP and EAD
 
I totally agree with Ginnu, although I didn't have any cover letter or signature card. Infact I didn't have the copy of EAD receipt since I had the copies of the card.

The order I had for both EAD and AP was (applying AP for first time)

2 Immigration pictures (with A# on the back)
Check
Form
Copy of 485
Copy of EAD (both sides)
Copy of I 94 (both sides)

I sent EAD and AP (mine and my wife's) in separate envelopes.
